On January 8, 2021, the Office of Federal Contract Compliance Programs (OFCCP) issued an opinion letter on “Legal Protections for Religious Liberty in the Workplace.” The opinion letter builds on OFCCP’s recent regulations regarding the religious exemption to provide broad protection to employees against discrimination based on their religious practices. The opinion letter appears to signal that OFCCP leadership is concerned that certain aspects of religious faith may be deemed controversial, leading to adverse employment actions against employees who hold these views. Although LGBTQ issues are not directly addressed in the opinion letter, the opinion letter’s principles could conflict with the increasing protections that federal and state employment discrimination laws provide to LGBTQ employees. ....

OFCCP Publishes Workplace Religious Liberty Protections Opinion

On January 8, 2020, the Office of Federal Contract Compliance Programs (“OFCCP”) published an opinion letter responding to an unidentified religious organization’s request for clarification on the “scope of the legal protections for religious liberty in the workplace.” The organization’s request stemmed from its concern that “employees in the technology, education, public, and other sectors may face discrimination at work based on faith-related activities and beliefs.”
Executive Order 11246 applies to federal contractors and subcontractors and, through its equal opportunity clause included in federal contracts, prohibits employment discrimination on a variety of characteristics, including religion. However, the executive order includes an exemption for religious corporations, associations, educational institutions, and societies with respect to the employment of individuals of a certain religion. Trump Executive Order on Diversity Training Enforcement Enjoined

As previously reported, on September 22, 2020, President Trump issued Executive Order 13950 on Combating Race and Sex Stereotyping (Order), which barred federal agencies, federal contractors, and recipients of federal grants from conducting diversity and inclusion training that promotes “divisive concepts” involving any form of “race or sex stereotyping” or “race or sex scapegoating.”

Not. i happen to have been pretty active at the state government level back at the time when chief justice roberts was working for the reagan administration. i remember very much their efforts trying to get rid of the office of federal contracts and compliance. we fought them then. we were able to demonstrate with the record that those programs were very much needed and, of course, ofccp was the federal agency working on affirmative action stuff. so justice roberts was against it then, and i would suspect he s still against it now. but congressman, you may remember what the chief justice said during his confirmation hearings back in 2005. just take a listen to this, sir. judges are like umpires. ....
