Bristol-Myers, Sanofi Ordered To Pay $834 Mln Over Plavix In Hawaii
NEW YORK CITY (dpa-AFX) - Bristol-Myers Squibb Co. and Sanofi SA were ordered to pay more than $834 million to the state of Hawaii for failing to issue proper warning of health risks to consumers from its blood thinner Plavix.
Judge Dean Ochiai in Honolulu pronounced that the drugmakers, which produced Plavix in a partnership, marketed the drug misleadingly to non-white patients. The fine was awarded as a civil penalty for violation of the state s consumer-protection laws. Bristol-Myers and Sanofi are ordered to each pay $417 million in penalties.
The companies allegedly marketed the drug without disclosing that it could have a reduced or no effect for some people, mainly of Asian or Pacific-Island ancestry. Studies said that about 14 percent of Chinese patients were unable to metabolize the drug properly, in comparison to 4 percent Black and 2 percent white patients. ....

(Reuters) - A judge in Hawaii on Monday ordered Bristol-Myers Squibb Co and Sanofi SA to pay more than $834 million to the state for failing to warn non-white patients properly of health risks from its blood thinner Plavix.

US court orders $834 mn from BMS, Sanofi on Plavix: reports


(MENAFN - AFP) A Hawaii court ordered Bristol-Myers Squibb and Sanofi to pay the state $834 million over marketing claims for blood thinner, Plavix, according to news reports.
The two pharmaceutical giants said they intend to appeal the decision, which concluded that the companies engaged in unfair and deceptive business practices.
The state of Hawaii alleged the companies misled consumers about the benefit of using the drug, particularly for people of East Asian ancestry.
The drug makers intend to appeal the trial court s decision and we are confident in our success on appeal, the companies said.
The state pointed to results showing the treatment did not work well for some patients of Asian or Pacific-island descent who could not properly metabolize the drug, according to the reports. ....
