The Court’s ruling means that Californians can continue buying pork products knowing they were not produced using extreme confinement practices – protecting not only animals but also workers who handle these products every day from harm caused by unsafe conditions.

The Supreme Court’s decision to allow California’s animal housing law to remain in place caused a furor in the pork industry and among farm-state lawmakers, who vowed to introduce legislation to overturn the ruling. But its more immediate impact could be felt in the approximately half of states that allow voters to craft law through ballot initiatives. 

SCOTUS upheld Proposition 12, finding the law is not an unconstitutional violation of the Court’s dormant Commerce Clause precedents, despite the Biden administration’s concerns that the decision would substantially disrupt the nation’s pork market.
