全面体现严格规范公正文明执法要求-时政-中工网

此次修法一个最重要的背景，就是把党的十八大以来全面依法治国、深化行政执法领域改革的重要成果落实在法律中。新修订的行政处罚法在总结行政执法实践经验基础上，针对行政执法实际问题，进一步丰富和完善了行政处罚的基本制度和规则，充分体现和巩固了行政执法领域取得的重大改革成果。
值得一提的是，新修订的行政处罚法既是一部“有力度”的法律，又是一部“有温度”的法律。一方面，此次修法坚持为行政处罚权行使定规矩、划界限，全面体现了严格规范公正文明执法要求。与此同时，新修订的行政处罚法新增一系列有针对性的规定，规范行使行政处罚自由裁量权，规范非现场执法和行政处罚信息化，提高行政效率的同时体现便民原则，强化当事人的陈述、申辩等权利保护。
保障正当权利完善处罚程序
据了解，行政处罚法实施后，各部门各地方根据实际情况进一步细化了行政处罚程序，积累了有益经验。国务院开展行政执法“三项制度”改革，全面建立行政执法公示、全过程记录和法制审核制度。
“在这次修法过程中，各方面提出大量完善行政处罚程序方面的意见建议。”全国人大常委会法工委立法规划室副主任黄海华介绍说，新修订的行政处罚法从多方面进一步充实完善了行政处罚的程序制度。一是丰富行政处罚程序类型，增加了应急行政处罚程序和非现场行政处罚程序，推动建立分层次、多类型的行政处罚正当程序制度。二是降低简易程序门槛和扩大听证程序适用范围，合理调整不同处罚程序的运用比重。
此外，新修订的行政处罚法补齐了全链条处罚程序，包括：增加立案程序，规定符合立案标准的，行政机关应当及时立案；增加行政处罚期限，规定行政机关原则上应当自行政处罚案件立案之日起90日内作出行政处罚决定；增加行政执法公示、执法全过程记录制度，完善重大执法决定法制审核制度；完善告知程序，明确行政机关在作出行政处罚决定之前，应当告知当事人拟作出的行政处罚内容；完善回避制度，细化回避情形，明确对回避申请应当依法审查，由行政机关负责人决定，决定作出之前，不停止调查；增加电子送达，当事人同意并签订确认书的，行政机关可以采用传真、电子邮件等方式，将行政处罚决定书等送达当事人；增加程序违法致使行政处罚无效的规则，等等。
确保公正严明规范非现场执法
实践中，行政执法领域利用科技手段实行非现场执法越来越多，取得了较好的执法效果，但应当看到，也带来一系列问题，亟待规范。在通过“电子眼”进行非现场执法的问题上，还存在着设置地点不合理、不公开，监控设备不合格、不达标，记录违法信息不规范、不告知的现象。
为保护当事人合法权益，着力解决电子技术监控设备执法不规范问题，新修订的行政处罚法对电子技术监控设备的质量要求、设置、使用和程序等作出了全面规定。
据全国人大常委会法工委行政法室处长张晓莹介绍，新修订的行政处罚法实现了五个“确保”，把住了五个“关口”，即确保采用非现场执法方式于法有据，把住“法律依据关”；确保电子技术监控设备质量过关、性能完备，把住“质量关”；确保电子技术监控设备的设置科学合理、公开透明，把住“设置关”；确保电子技术监控设备记录内容准确无误、客观全面，把住“记录关”；确保电子技术监控设备记录信息有效告知当事人，把住“告知关”。
“围绕新规定，需要从四个方面做好相关工作。”张晓莹说，有关立法机关应当及时清理相关规定，对于超出权限作出的非现场执法规定进行清理；有关行政机关应当及时补充法制审核、技术审核、公布设置地点等手续，完善电子技术监控设备设置的合法性；有关行政机关要及时检定相关设备，对不符合标准的电子技术监控设备，及时淘汰、更换；有关行政机关要及时优化技术手段措施，提升电子技术监控设备记录信息的告知效率、效果。既要及时，又要便捷，既要充分运用现代科技手段，也要兼顾不同群体需求。
