Would benefit from sentencing changes not in the first step act if they were made retroactive, and they have bipartisan support, so what s holding them up? unfortunately in washington, so many times, politics over people holds it up. when the first step act was first passed, many people who are incarcerated petitioned to have their sentences reduced, and federal prosecutors who were on the ground having direct interaction with those individuals were going in the direction to reduce those sentences. but leadership matters, and under william barr, the sitting attorney general, under his leadership, those petitions were paused and requested to go in a different direction. so the first step act does do some great things, but the leadership under the justice department has to actually want criminal justice reform to happen. it s a very important issue that we re going to continue to follow here on msnbc. ashley ellison, happy holidays and thank you very much for taking the time to talk ....

Constraints for situations like this. the remedy really is political. once again, we just aren t seeing the kind of reaction that we would expect for this really astonishing sort of report to come out. we aren t seeing democrats responding, you know, anywhere near the level of energy or outrage we might expect. and to be clear, our legal analyst made this point to me in the last hour. the pardon explicitly cannot be discussed in advance of the prosecution of a crime, correct? you can t bring it up before. it s only retroactive. right. so the pardon power itself is retroactive. the president does have the power or ability to essentially pardon a crime in advance. i don t know that there s anything that prohibits, as a legal matter, him discussing the possibility of pardoning in the future. of course, whether or not you want to rely on donald trump s word, that would be a decision that individuals would have to make for themselves. ....

Quarter of a million people that are elder in prison that all the data shows pose little threat to us and most are there for egregiously long nonviolent drug terms. you have 65-year-old, 75-year-old people who are expensive to keep behind bars and pose little threat and put in prison under draconian times and even those of us voted for the first step act, which i helped right. they are not made retroactive. i just believe we should have judges start to take a second look at many of these people that are incarcerate and if they find there is no reason to keep them in jail, this includes any victim statements or what have you. take that look and have a presumption for release so that we can save billions of tax bayer dollars getting those who pose no threat on sentences that ....
