Canadian Supreme Court affirms trans-boundary Sinixt hunting rights

NESPELEM, Wash. — There was celebration amongst members of the Confederated Tribes of the Colville Reservation and Sinixt Confederacy on Friday as the Canadian Supreme Court ruled in their favor.
The court dismissed the Crown’s final appeal in the
R
v. Desautel hunting case, which will allow the Sinixt Nation, whose reservation lies in Washington state, access to hunt in ancestral territory within the Canadian border.
In 2010, Rick Desautel was charged with hunting elk as a non-resident, and without a license, near Castlegar, B.C., which falls within the heart of Sinixt traditional territory.

Canada's top court on Friday restored the ancestral rights in this country of an indigenous tribe declared "extinct" by the government a half century ago, but with roughly 3,000 descendants still living in the United States.
In a 7-2 decision, the Supreme Court said the Sinixt Nation, who claimed to have once occupied a valley stretching from what is now Kettle Falls, Washington, to Revelstoke, British Columbia, have constitutionally protected rights to hunt on those territories.
