Wine Country Counties Sue Governor Newsom Over Outdoor Dining Closure


Outdoor dining helped Fume’ limp along after the pandemic reopenings months ago, Letson said it at least allowed him to pay the bills.
But he says he began draining savings when the latest COVID-19 surge forced all on site dining to shutdown. 
Take-out alone will not keep his lights on, and Letson says a lot of restaurants and wineries in Napa and Sonoma counties are in the same boat.
More than 50 of them joined a group called Wine Country Coalition for a safe reopening. 
They built a website laying out their argument for a safe reopening and on Tuesday, they filed a lawsuit alleging the outdoor dining restrictions violate the California constitution’s equal protection and due process clauses.

Public health experts are growing concerned that emerging vaccination delays may mean it will take longer to reach immunity levels necessary to control the pandemic, especially as cases are still surging and ICUs are in full crisis mode.

Defiant Napa restaurant, Fumé Bistro, calls health order 'unjust,' continues offering in-person dining


The county's website currently lists their ICU capacity at 0 percent.
"I feel the numbers are inflated. There's no evidence I've seen that shows the numbers are high due to outdoor dining. To me its worth the risk," said Phillip.
Scott Sedgley, Mayor of the City of Napa, called the restaurant's decision to stay open "unfortunate."
A Napa County spokesperson tells ABC7 the City of Napa and the County are aware that the restaurant has been serving customers in person. They said they have referred the complaints to the state coronavirus enforcement taskforce as well as the Department of Alcoholic Beverage Control.
