IBA and The College of Law Australia launch online anti-harassment training for the legal profession

IBA Immediate Past President Horacio Bernardes Neto, who championed the
Us Too? campaign throughout his two-year (2019–2020) presidency, commented:
‘The IBA is committed to ensuring that the legal profession is a safe, supportive and respectful environment for every member of it. The development of this training is another demonstration of that commitment. We must maintain momentum, and we hope legal workplaces across the globe deploy the training for their staff and that they find it practical and edifying.’
Kieran Pender, the former
Us Too? campaign and co-developed the training, said:
‘Effectively addressing the prevalence and impact of inappropriate behaviour in law requires a multifaceted strategy akin to a many-piece puzzle. Training is one really important piece of that puzzle. The Us Too? report emphasised that “the profession should make a concerted effort to improve the frequency and quality of training to address bullying and sexual harassment”. Our intent in developing this training was to contribute to that collective effort.’

Japanese technical staffing firm BeNext, formerly known as Trust Tech (2154: JP) reported revenue yesterday of JPY 37.56 billion (USD 358.6 million), a decrease of 8.1% when compared to the prior year.

The group’s results were impacted by the pandemic. The group highlighted a fall in labour demand in the UK due to the country’s lockdowns. The group’s presence in the UK includes Gap Personnel and MTrec.
While operating income was down, during the period the group had received employment adjustment subsidies.
Last month the group announced it is merging with Yumeshin Holdings Co. Ltd, (2362:JP), a Japanese holding company mainly engaged in the business of labour dispatch. The absorption-type merger will see the creation of an engineer dispatching powerhouse. The merger will see BeNext as the surviving company.

A year of opportunity – and threats

Traditionally, this is the time when people make predictions for the year ahead – but in 2021 predictions seem somewhat hollow. Nobody anticipated 2020’s global pandemic, although it has been flagged up as a possibility multiple times in recent decades. In fiction, Nigel Watts’ 1995 novel Twenty Twenty is set in 2020 during a pandemic (Watts died in 1999, so did not witness the accuracy of his dystopian vision). ‘If anything kills over 10 million people in the next few decades, it’s most likely to be a highly infectious virus rather than a war,’ said Bill Gates in his 2015 TED talk, ‘The next outbreak? We’re not ready’, which was inspired by West Africa’s Ebola virus epidemic. However, I cannot find mention of a likely pandemic in predictions for 2020.

While it remains incumbent upon employers to address harassment, there may be scope for tech providers to offer practical assistance to and collaborate with workplaces to stamp out such misconduct.
Technology is “not going to ‘solve’ the legal profession’s ‘harassment’ problem”, Kieran Pender (pictured) and Emma Franklin submit. That said, tech solutions – what they call Trust Tech – could potentially have a “constructive role” in facilitating the reporting of incidents, which they perceive to be a necessary step in addressing misconduct in legal workplaces.
