The Colorado Court of Appeals rendered an interesting decision in March 2020:
The central issue focused upon the assignment of an impairment rating by the treating physician. The Court recognized that the American Medical Association Guides to the Evaluation of Permanent Impairment have been in use for years, and that reference to various editions of those Guides may result in various impairment ratings for the same malady and complaints. It is somewhat intriguing as consistency is one of the overarching goals of the Guides.
The Court explained that the inconsistencies between various Editions result from “emphasis of certain areas, and as a a reflection of the latest consensus in medical science within its subject matter.” The Court noted that the Colorado statute mentions the Third Edition, which was published in 1988. Jan. 8 Workers injured on the job in Kansas can continue to be evaluated for impairment following medical guidelines that might reduce the amount of their workers compensation award, the state Supreme Court ruled.
In a decision released Friday, justices reversed a ruling from the Kansas Court of Appeals that favored Howard Johnson, but also avoided the constitutional question Johnson posed.
Johnson suffered a serious spinal cord injury while working as a delivery driver for U.S. Food Service. His workers compensation award was nearly $47,000 less than what he would have received if the injury had occurred a year earlier. ....
