PARKERSBURG – A circuit judge again has certified a case involving a 2017 Parkersburg warehouse fire as a class action. An attorney for the defendant, however, says the issue again will be appealed to the state Supreme Court On June 17, Judge Thomas Bedell issued an order granting class certification in the case Paul Snider, a Parkersburg man, filed against Surniak Holdings of WV LLC in Wood Circuit Court. Bedell, a circuit judge from Harrison County, is hearing the case because the state Supreme Court previously recused all Wood County judges from the case. McLaughlin Surniak once had this and other related cases removed to federal court, but they were remanded back to state court. That’s where the class, which could include more than 50,000 people, was certified once before by Bedell. But Surniak appealed that decision to the Supreme Court, which then sent it back to Bedell for more analysis. ....
LEXINGTON, Kentucky – A group of West Virginia attorneys have filed a third lawsuit claiming another female federal inmate was raped, sexually assaulted and battered while incarcerated at a Kentucky prison. The plaintiff, identified only as W.T., filed the complaint May 25 in federal court against the federal government and Residential Drug Abuse Program Instructor Hosea Lee at the Federal Medical Center Lexington. The core group of her attorneys, including L. Dante diTrapano, are from West Virginia and have filed several similar lawsuits in recent years, including one earlier in May against Lee. diTrapano “Correctional officers using their authority, control and power to rape female inmates is an epidemic in our prison system,” diTrapano told ....
CHARLESTON – A New York bankruptcy court order is allowing more than 270 additional claims to be filed on behalf of West Virginia children suffering from Neonatal Abstinence Syndrome. Last month, federal bankruptcy Judge Robert D. Drain issued an order in U.S. Bankruptcy Court for the Southern District of New York in Purdue Pharma’s bankruptcy case that allows the filing of 272 NAS claimant proofs of claim. ““It is now clear that many, many families did not receive notice of the Purdue bankruptcy,” attorney Booth Goodwin told The West Virginia Record. “We were certainly pleased to be able to provide these parents and guardians with the opportunity to submit claims on behalf of their children who really are the most vulnerable victims of the opioid crisis.” ....
