Re-Registration Of Non-JK Registered Vehicles: HC Directs AG To Appear Before Court

SRINAGAR: Entertaining a plea challenging the recent order issued by the Regional Transport Officer Kashmir for the re-registration of vehicles bought outside Jammu and Kashmir, the high court directed the advocate General to appear before the court on Wednesday, April 07, 2021 while hearing this matter.
The writ petition WP(C) No 669/2021 titled Zahoor Ahmad Bhat Vs Government of Jammu and Kashmir and others, challenging the impugned order issued by RTO Kashmir dated 27/03/21 was listed on Monday before the court.
The court decided to hear the matter and directed Advocate General to present before the court on April 7, 2021.
Since this order was issued, dozens of vehicles with a non-Jammu and Kashmir registration have been seized by the authorities across Kashmir after a decision to get such vehicles re-registered with the Jammu and Kashmir government. ....

SRINAGAR: Jammu and Kashmir high court on Tuesday ordered that the conduct of the proposed elections of the office bearers of the Jammu and Kashmir Cricket Association (JKCA) shall remain in abeyance.
Reserving its orders on a number of appeals filed by various parities including City Cricket Club, Srinagar and Others, a bench of Justices Ali Mohammad Magrey and Puneet Gupta also directed that till the final decision in the matter, the Committee of Administrators (CoA) so appointed by the court shall only look into the routine day to day affairs of the Jammu and Kashmir Cricket Association (JKCA). ....

HC Notice To Govt On Plea By Family Seeking FIR, Probe Report Into Kin’s ‘Custodial Death’
SRINAGAR: Jammu and Kashmir high court has issued notice to the government on a plea by a family from Sopore area of north Kashmir’s Baramulla district, seeking a copy of a magisterial enquiry report and filing of FIR into the alleged “custodial death” of their kin in September last year.
A bench of Justice Ali Mohammad Magrey has sought the response by May 12 after hearing advocate Shafaqat Nazir for the family which alleges that their kin, Irfan Ahmad Dar of Sidiq Colony Sopore, was killed in alleged police custody on the night of September 16 last year as against the official version that the 23-year-old’s body was found near a quarry at Tujjar-Sharief after he “escaped taking advantage of the darkness.” ....

Authorities 'Guilty' If Detainee Not Informed About Representation Right: HC

SRINAGAR: Authorities are guilty of committing an infraction of a constitutional right by not informing a detainee about the right to make representation to detaining authority, Jammu and Kashmir High Court has said.
“It can safely be stated that the respondents (authorities) by not informing the (detainee) about his right to make a representation to the detaining authority against the impugned order of detention, are guilty of committing an infraction of a Constitutional right guaranteed to the (detainee) under Article 22(5) of the Constitution and the statutory right guaranteed to him under Section 13 of the J&K Public Safety Act,” a Bench of Justice Sanjay Dhar said as per news agency GNS and quashed detention order under PSA passed by the deputy commissioner Budgam against one Aijaz Ahmad Dar of Nasrullapora as being “unsustainable in the eyes of law.” ....
