The Trademark Modernization Act (TMA) is an amendment to the Lanham Act concerning trademark disputes, signed on Dec. 27, 2020. The TMA includes a number of changes and enhancements to trademark disputes. The changes concerning actions at the USPTO are tremendous and the subject of another article. These few paragraphs concern the major change to the law as it affects litigation of trademark claims in Federal Court with the resolution of a Federal Circuit split. The TMA creates new law, such that a trademark owner is now entitled to a rebuttable presumption of irreparable harm upon a showing of trademark infringement. This gives trademark owners substantially more power and certainty when enforcing trademarks and will limit forum shopping. Before launching into the details of the TMA, it is important to explain the history and the state of the law before the TMA was passed. ....

White's Ferry near Leesburg, Virginia ceases operations

The owners of White s Ferry have ceased operations after a Loudoun Circuit Court ruling found there is no record documenting the establishment of a public landing on the Virginia shore.
The case was brought by the owners of Rockland Farm, where the landing and its access road have supported a ferry for more than two centuries. A lawsuit over the public access began in 2004 with the ruling coming in November as a result of a litigation filed in 2009.

White's Ferry river crossing in Montgomery Co. ceases operations after court decision


The operator of White’s Ferry, the historic Potomac River crossing in Poolesville, Maryland, announced Monday it would close up shop immediately following a judge’s decision in a decade-long court case brought by a Virginia property owner.
As a result, the ferry operator, which has docked on the Virginia side of the river for over two centuries, announced its closure via a Facebook post at 10 a.m. Monday.
The ferry operators cited a Loudoun County Circuit Court ruling in November.
The Nov. 23 decision, Stephen E. Sincavage of the Loudoun County Circuit Court awarded damages to the owner of the Virginia property owner, known as Rockland Farm, in excess of $100,000, agreed that White’s Ferry had been trespassing since the end of a licensing agreement in 2004 and through an injunction, prevented White’s Ferry from continuing to use the land. ....
