Gov. Abbott backs Exxon in climate change case, tells Cali officials to mind their own business

AUSTIN – No Texan voted for the California officials who are orchestrating climate change “lawfare” against his state’s energy sector – oil and gas companies that employ hundreds of thousands and bring in billions in tax revenue, says Gov. Greg Abbott.
Currently, the Texas Supreme Court is considering ExxonMobil’s petition of review, which asserts California municipalities and a Massachusetts lawyer are attempting to chill speech and commandeer public policy, subjecting them to personal jurisdiction in Texas courts.  
On May 6, Abbott filed a brief in support of Exxon, asking the Supreme Court to grant the petition for review in order to “resolve an important legal question with major implications for the energy sector in the State of Texas.” ....

Exxon on climate change litigation: Non-residents using lawfare to suppress Texas speech subject to Texas jurisdiction

AUSTIN – The parties accused of orchestrating climate change “lawfare” against the energy sector are feigning shock that their attempts to chill speech and commandeer public policy could be subjected to personal jurisdiction in Texas courts, ExxonMobil argues in a recently filed brief.  
Last June, an appellate court ruled it does not have jurisdiction over California cities and counties pursuing climate change lawsuits against the energy sector.
The case is now currently before the Texas Supreme Court. Justices have been tasked to decide if ExxonMobil has the authority to investigate those who allegedly orchestrated the litigation.
Exxon argues that the “potential defendants use tort suits to impose their preferred climate and energy policies on Texas.” ....

FORT WORTH – The parties accused of orchestrating climate change “lawfare” against the energy sector are asking the state’s highest court to deny ExxonMobil’s petition of review.
Last June, an appellate court ruled it does not have jurisdiction over California cities and counties pursuing climate change lawsuits against the energy sector.
The case is now currently before the Texas Supreme Court. Justices have been tasked to decide if ExxonMobil has the authority to investigate those who allegedly orchestrated the litigation.

With trials paused due to the pandemic, who is in jail and who is not has more to do with who can afford bail than who is guilty of a crime. It is another existing trend exacerbated by the lengths governments are going to slow the spread of the coronavirus. Even before the pandemic, about 70 percent of the roughly 5,000 people held in the Lew Sterrett Justice Center were only there because they couldn’t afford to post bail.  ....
