Contra Costa joins state program aiming to rectify excessive prison sentences

A state pilot program will help the Contra Costa County District Attorney’s Office process resentencing applications from inmates in state prisons in a more timely manner.
On Friday, the DA’s office was notified that it was selected to participate in the California County Resentencing Pilot Program, funded under the state budget signed recently by Gov. Gavin Newsom. The program builds upon Assembly Bill 2942, which “allows for a district attorney to review old sentences and determine if the sentence still serves the interest of justice and the community,” the DA’s Office said. ....

Convicted burglar is 1st to be resentenced in Contra Costa County under new law

Derric Craig Lewis, 61, was convicted of residential burglary and sentenced to 27 years in prison.
That sentence was revised on April 16, when the Contra Costa County Superior Court reduced it to 17 years the time he had already served.
In October 2004, Lewis took BART to Orinda where he entered a residence while two people were in the home.
He stole a purse and a bike. He later said that he stole the property to purchase drugs to support his addiction.
At the time of the offense, he was on probation after a number of felony convictions. ....

Contra Costa DA makes changes to civil asset forfeiture policy

Contra Costa County District Attorney Diana Becton has announced the formalization of a new policy for civil asset forfeiture cases within the DA’s Office. The move now makes an interim policy instituted in June 2019 permanent and applicable to the whole county.
Civil asset forfeiture cases are a civil procedure for law enforcement to seize cash and other property from suspects alleged to have connections to drug trafficking and sales.
According to the DA’s Office, the formalized policy encompasses a new threshold for cases, in that the amount seized must total at minimum $1,000 for her office to consider utilizing the civil asset forfeiture process. Under prior administrations, the amount seized could be as low as $500. ....
