10th Circuit sides with city of Aspen in Mill Street Plaza dispute


The 10th Circuit Court of Appeals this week affirmed the dismissal of a lawsuit against the city of Aspen that challenged its zoning laws concerning a parcel of commercial space with locally serving businesses.
The three-judge panel delivered its 31-page ruling Tuesday, upholding Chief U.S. District Court Judge Philip Brimmer’s March 2020 dismissal of the suit levied by North Mill Street LLC, a Mark Hunt-controlled limited liability company that owns Mill Street Plaza.
Like Brimmer, the panel concluded the LLC’s suit wasn’t “ripe” for litigation because Hunt, a developer with multiple commercial properties peppered through downtown Aspen, didn’t exhaust the city’s land-use approval process by seeking a planned development review. The LLC, however, unsuccessfully tried to rezone the property so free-market apartments could be built at the plaza, which is located across Puppy Smith Street from the Clark’s Market shopping center. ....

Judge: Condo association can keep fining landlord for allowing Aspen pot shop, wine cellar


A judge’s ruling last week delivered a blow to a landlord and his two tenants, a pot shop and a wine cellar, both of which face eviction because of new rules governing a downtown Aspen building.
For landlord Douglas Tomkins, District Court Judge John Neiley’s order means Aspenhof Condominium Association can continue to fine him $500 daily for not evicting his tenants Best Day Ever marijuana dispensary and Betula restaurant, which leases a unit to store wine.

Neighbors, nonprofit take Aspen to court over Cooper housing proposal

A worker-housing project proposed for an east Aspen neighborhood now has legal hurdles to clear in addition to governmental ones.
An Aspen condominium association and a nonprofit organization filed separate complaints late Friday against the city of Aspen over City Council’s 3-2 decision April 19 to remand an application for a five-unit housing complex back to the Historic Preservation Commission, which originally denied the proposal.
Using attorneys from different Aspen law firms, the plaintiffs Cooper Avenue Victorian Condominium Association Inc. and the group Save Aspen introduced the complaints in Pitkin County District Court. Both lawsuits were filed under Colorado’s Rule 106, which allows citizens to appeal to the courts a governmental body’s decision on land use and development ....

Avon moves one step closer to legalizing use of OHVs on Wildridge roads

Debate and discussion surrounding the use of off-highway vehicles on Avon public roads in Wildridge continued at Tuesday night’s Town Council meeting.
that would legitimize the use of off-highway vehicles within the Wildridge subdivision. This topic was first breached, and the ordinance initiated, at the April 13 Town Council meeting.
Specifically, the ordinance designates all town roads and streets within Blocks 1 through 4 of the subdivision, beginning above the 2000 Block of Wildridge Road (south of the intersection of Wildridge Road and Old Trail Road). The ordinance also stipulates the following:
