The climate verdict of the German Constitutional Court – Felix Ekardt and Franziska Heß

Felix Ekardt
Last Thursday, the German Constitutional Court released a groundbreaking verdict on climate change, freedom and human rights. Following the first of four adjudicated lawsuits (represented by the two authors), the court understands climate change as a twofold freedom challenge: climate change itself and climate policy can become highly relevant for human rights to freedom. And freedom rights are something to which future generations and people worldwide not only in Germany are entitled.
Legislators must therefore organise the path to zero emissions which the court sees as required under constitutional and international law in a way that is as forward-looking and freedom-friendly as possible. In doing so, each generation must do its fair share if there is to be a timely shift to zero fossil fuels in sectors such as electricity, buildings, transport, cement, plastics and agriculture and to greatly-reduced animal husbandry. In any event, following the ruling the P ....

20 Best Countries to Live Considering Climate Change

20 Best Countries to Live Considering Climate Change
Climate change is posing existential threats to the world. It has become evident with extreme weather, shrinking glaciers, accelerated sea levels,  and record floods that global climate change is on the verge of destroying the environment. Climate change can be referred to as the significant increase in Earth’s temperature due to activities like burning fossil fuels (leading to carbon emission), deforestation, and intensive agriculture. The more scientific aspect of this change is Global Warming, caused by the increased concentration of greenhouse gases in the atmosphere. According to the Annual Climate Report 2020 report by NOAA, the land and ocean temperature have increased at an average of 0.08 degrees Celsius per decade since 1880. This change in temperature does not only affect humans but puts wildlife in equal danger. The Intergovernmental Panel on Climate Change states that this temperature rise may put 20-30% of s ....

Historic German court decision rules climate inaction violates rights of the young

30 April 2021
The highest court in Germany has ruled that the government’s climate policies are insufficient because they do not detail emissions reductions past 2030. This violates the freedoms of young people, as it potentially ‘backloads’ climate action onto future generations in addition to burdening them with the consequences of short term inaction.
Germany’s ‘Climate Action Law’ came into effect in late 2019, as part of a package of policy designed to reach the country’s 2030 climate targets. This is a 55% reduction in greenhouse gas emissions by 2030, including sector-specific annual emissions budgets up to 2030.
However, “the provisions irreversibly offload major emission reduction burdens onto periods after 2030”, said Germany’s top court. “For this target to be reached, the reductions still necessary after 2030 will have to be achieved with ever greater speed and urgency. These future obligations to reduce emissions have an impact on pra ....
