Kirby Wins Bench Verdict, $17 Million On Collision, Spill

On July 8, a federal district judge in Houston exonerated Kirby Inland Marine from any liability or fault in a May 2019 collision in the Houston Ship Channel. The collision between one of its tank barges and an oceangoing vessel, the Genesis River, resulted in the Kirby barge releasing 473,600 gallons of reformate, a gasoline blending stock, into the channel. The bench ruling was a finding of fact and law that the operator of the Genesis River holds 100 percent of the liability, making any subsequent appeal unlikely.
Judge Jeffrey Brown of the United States District Court of the Southern District of Texas, Galveston Division, ruled that the captain of the Genesis River failed to disclose to the two harbor pilots that his boat had poor handling and was recommended to go no faster than 6 to 8 knots within the Houston Ship Channel. Texas sheriffs, Federal Police Foundation sue Biden, feds over immigration policy


(The Center Square) – Several Texas sheriffs and the Federal Police Foundation sued President Joe Biden Thursday for what they say is his administration’s “unlawful and unconstitutional” policies related to removing criminal illegal immigrants from the country.
The counties and their sheriffs filing the lawsuit include Kinney County Sheriff Brad Coe, Montgomery County Sheriff Rand Henderson, Edwards County Sheriff J.W. Guthrie, McMullen County Sheriff Emmett Shelton, Hudspeth County Sheriff Arvin West, Galveston County, and the Federal Police Foundation-ICE Officers Division. More counties are expected to join the lawsuit.
They filed suit in the U.S. District Court for the Southern District, Galveston Division, represented by Kris Kobach, the former attorney general of Kansas, with Alliance for Free Citizens, Kinney County Attorney Brent Smith, and Chris Hajec with the Immigration Reform Law Institute. ....

Fidelity wins data as plan asset case | Ary Rosenbaum


Fidelity won a huge case.
Schlichter, Bogard & Denton brought a lawsuit on behalf of four participants in Shell Oil Co.’s 401(k) plan. While the case focused on excessive fees, it alleged that the use of participant data by Fidelity, the recordkeeper to solicit non-plan-related services was wrong. The complaint alleged that Shell and Fidelity caused the Plan to engage in transactions that constituted a plan asset.
U.S. District Judge Jeffery Vincent Brown of the District Court for the Southern District of Texas, Galveston Division granted Fidelity’s motion to dismiss those claims.
The Judge threw out the participant data as plan records because regulations promulgated under ERISA don’t consider participant data as a plan asset. Also, the complaint tried to imply that Fidelity was a fiduciary and they certainly weren’t. ....
