Colorado Springs City Council wants to retain say in land-use appeals


Colorado Springs City Council members informally decided Monday they want to stay involved in most appeals involving major land development projects, after hearing major opposition to a proposal that would have cut them out.  
A proposed revision to the appeal process in the update to the zoning code would have required appeals of property rezonings, one of the most major land-use decisions, to go to court and bypass the City Council. The draft also proposes allowing lower boards of appointees, such as the Planning Commission, to have the final say on administrative decisions like plats, or final plans to subdivide properties.

A variety of questions and proposed tweaks came with the initial review of the second of three installments of Rochester’s draft Unified Development Code on Monday.
“Are we setting up the (Unified Development) Code to be a set of rules, so that once you pass them you get approved, or are we setting up that our (Community) Development team will have judgement on whether something adheres to the zoning or not?” Rochester City Council member Patrick Keane asked.
The latest sections of the proposed code include development standards that regulate the site and appearance of what is allowed in each defined zone of the city.

Development standards for new Rochester code near public review


The added proposed content seeks to provide simplified language related to how buildings can be constructed in each zoning district, by defining acceptable building sizes, required parking, sign limitations, landscaping expectations and other requirements.
The transition to a Unified Development Code has been discussed during recent public hearings related to rezoning parcels in the city to accommodate future development. Community Development staff have pointed to the need for a clearer code to help residents and developers better understand what can be built, without requiring a complex public review process.
“What we need to be doing is make sure we understand what the base zoning will produce,” Ryan Yetzer, the city’s interim deputy director of development and construction service, said during a discussion of zoning and standards at a council meeting earlier this month.

A developer of 15 rental units under construction near Saint Marys Hospital recently questioned why a similar project proposed for down the street is taking a different path toward approval.
“I would suggest following the same process used for Cottage Grove,” Michael Linsdsey said of the small development being built on 14th Avenue Southwest.

Those were among the ideas floated for the future of Short Pump Town Center in a weeklong charrette that concluded in late February.
More than 85 people took part in the daily series of planning sessions, which served to bookend a years-long effort to update Henrico County’s code to include form-based zoning, an optional but heavily incentivized approach to encouraging development and redevelopment in certain areas of the county.
