Sotto: Economic Cha-cha has chance in Senate, but foreign investments bills still priority

Metro Manila (CNN Philippines, July 21)  The proposal to amend the economic provisions of the Constitution still has some chance in the Senate, but key economic bills remain a priority when session resumes next week, Senate President Tito Sotto III said Wednesday.
In his taped interview with CNN Philippines
The Source, Sotto said the Resolution of Both Houses 2, which the House of Representatives approved on June 1, has been referred to the Senate Committee on Constitutional Amendments.

At a webinar last Wednesday, the Senate Committee on Constitutional Amendments and Revision of Codes chaired by Senator Francis Pangilinan held a hearing on the timeliness and procedural issues as well as the substantives (suggested resolutions by both houses on convening as a constituent assembly to amend restrictive economic provisions on land, natural resources, public utilities, media, advertising, and educational institutions). The issue raised was whether there is need to amend or revise the Constitution,  given the state of the pandemic and the national and local elections in 2022, and whether these should be done through a Constitutional Convention or a Constituent Assembly.  If by the latter, should the Senate and the House vote jointly or separately? ....

Cayetano, during the Senate Committee on Constitutional Amendments, Revision of Codes and Laws hearing on the various Charter change proposals, said that if lawmakers are bent on improving the economic conditions in the country, inviting more foreign investors to the Philippines and make it easier to transact business with the government, the passage of the CREATE bill would help resolve the matter.
“The first step there would have been (the) CREATE bill. If that is the objective, the first thing that could have been done was to pass CREATE,” Cayetano said during the panel’s virtual hearing. ....

Appearing in today’s public hearing by the Senate Committee on Constitutional Amendments and Revision of Codes and Laws on resolutions seeking to amend the 1987 Philippine Constitution were former Supreme Court Justice Adolf Azcuna, former Supreme Court Associate Justice Vicente Mendoza, former Commission on Elections (Comelec) Chairman Christian Monsod, and Fr. Ranhillo Aquino, Dean, Graduate School of Law, San Beda College.
They agreed that amending the 1987 Constitution shall be done separately via three-fourths votes of the Senate and the House of Representatives.
Aquino said both Houses of Congress voting separately upholds the bicameral nature of the two chambers. Congress is a partisan body, he added. ....

Inserting a simple phrase in the 1987 Constitution to amend the so-called restrictive economic provisions may open the gates of corruption in Congress, lawyer and former Constitutional Commission member Christian Monsod said Wednesday.
During a hearing of the Senate Committee on Constitutional Amendments and Revision of Laws, Monsod said Resolution of Both Houses No. 2 was motivated by thirst for power and money.
RBH 2 is dangerous and devious because it is a wholesale transfer of power from the Constitution to the Congress in determining the limitations of foreign ownership of land, natural resources, public utility, media, advertising, education and institutions, said Monsod, who is also a former Comelec chairperson. ....
