Sebamed's campaign targeting HUL soaps comes to a halt for now as Bombay High court restrains its commercials from all mediums

Bombay High Court held that the FMCG giant has made a strong prima facie case for grant of ad-interim relief.
The matter will now come up on January 14, 2021.The Bombay High Court on January 11 passed an injunction order after HUL took Sebamed’s campaign that took a dig at the company’s soap range to the court restraining its campaign from all mediums.
In Sebamed’s advertising campaign, it had claimed that its cleansing bar is better than soaps like Dove, Rin, Pears and Lux that its competitor
Hindustan Unilever offers. It also compared Lux and Pears with Rin, a detergent bar, implying that HUL’s products are inferior to Sebamed. ....

What do you do if you have a mass market ready product languishing in a niche category? This was precisely the state of Sebamed for almost a decade of its presence in India.
The over 50-year-old German skincare brand was introduced in India in 2007 as an OTC (over-the-counter) medication by Mumbai-based pharma company USV.
Until around a couple of years back, Sebamed found mention only in the prescriptions of dermatologists. Around 2018-19, the company realised that there was a rather large opportunity in the over Rs 20,000 crore Indian soap market and decided to test the waters with smaller influencer led marketing initiatives. ....

MUMBAI: The Bombay High Court on Monday restrained until further order USV Pvt. Ltd., the distributor of German skincare brand SebaMed’s products in the country, from running advertisements that Hindustan Unilever Ltd (HUL) alleges disparage its products.
HUL, the maker of personal care products, including
Lux, Dove and Pears, had approached the court to restrain USV from publishing and airing advertisements which, it alleged, claim that SebaMed’s products are superior. USV takes care of distribution and marketing for SebaMed in India. ....
