Weldon explains how public acts changed foreclosure procedures for county

At the June 22 Cheboygan County Board of Commissioners meeting, Cheboygan County Treasurer Buffy Jo Weldon explained to the commissioners several public acts that have changed how the county handles property foreclosures.
Public Acts 255 and 256 of 2020 have made modifications to the General Property Tax Act after a Michigan Supreme Court ruling. This ruling determined that people with interest in tax foreclosed properties have rights under the Michigan Constitution to the proceeds gathered at auction over and above the amount of the back taxes, penalties, fees, interest and other costs owed on the property.
This decision made a drastic change in our foreclosure law, said Weldon. We are no longer able to transfer the sales proceeds to the general fund. We haven t transferred proceeds in several years, just based on possibility of this decision. ....

Michigan County Treasurers are speaking out after word of state and federal lawsuits over the proceeds from tax foreclosures.
We reported last week that an attorney has filed class-action lawsuits in 19 counties, and is working on a federal suit against 43 counties – claiming that treasurers are going against a state Supreme Court ruling. At that time, 9&10 contacted two of the affected counties in northern Michigan, but we did not receive a response from our request for comment. ....

BAY CITY, MI - New legislation recently set the stage for other municipalities to follow in Bay City’s footsteps by entering into public-private partnerships for infrastructure improvements.
Gov. Gretchen Whitmer put the final stamp of approval on a set of bills that allow municipalities throughout the state to engage with private companies to improve aging bridge infrastructure and to authorize the implementation of tolling measures.
Senate Bills 1215-1218, now PA 353-356, were introduced in mid-November by Senator Ken Horn, R-Frankenmuth, Jeremy Moss, D-Southfield, and Wayne Schmidt, R-Traverse City. ....

LANSING, Mich.  Today, Governor Whitmer signed Senate Bills 241, 676, 1137, 1234 and 1246 as well as House Bills 5481 and 5824 into law.
 
Senate Bill 241, creating the Water Shutoff Restoration Act, promotes access to clean water and protects Michiganders from the spread of COVID-19 by ensuring that every occupied residence has access to clean running water so that they can regularly hand-wash consistent with CDC guidance. The bill prohibits water shutoffs due to nonpayment and mandates that water services be restored to residences where shutoffs have occurred, in most circumstances, through March 31, 2021. This bill was sponsored by Senator Stephanie Chang, D-Detroit.  ....
