The Delaware Superior Court has approved a $65 million class action settlement in one of the Mountaire environmental civil lawsuits. By settling, the Mountaire companies do not admit responsibility for the alleged groundwater or air contamination caused by their wastewater disposal activities â but the company agrees to pay people who may have been affected in a roughly 25-square-mile zone.

WILMINGTON, Del. (Legal Newsline) – AstraZeneca has received a positive ruling in Delaware in a lawsuit that alleges it failed to warn users of side effects of the blood sugar drug Farxiga.
Judge Sheldon Rennie on April 5 tossed all of the claims of Jeffery and Cynthia Pope against AstraZeneca and Bristol-Myers Squibb. Jeffery alleged Farxiga was responsible for the Fournier’s gangrene – a flesh-eating infection of the genitals.
But Rennie ruled the lawsuit filed by lawyers at Jacobs & Crumplar and Tracey, Fox, King & Walters failed to adequately make that accusation under controlling Texas law.
“Here, the warnings and information that accompanied Farixga’s distribution were approved by the (Food and Drug Administration),” Rennie wrote.

SEAFORD, Del. (AP) - The family of a Delaware woman who was fatally shot by police claims the woman was killed after a state trooper fired his gun through a closed door.
The Delaware State News reported Tuesday that the family is calling for more investigation into the March 25 incident in Seaford.
The family issued a statement through an attorney. It said that Kelly E. Rooks, 51, was in the midst of a mental health crisis when she called 911 for help.

The family of a Seaford woman claims a Delaware State Police officer shot and killed her through a closed door.
Police went to Danny Drive in Seaford the evening of March 25 to assist medical personnel, Delaware State Police spokeswoman Heather Pepper said.
As both medical personnel and police were engaging 51-year-old Kelly Rooks, she armed herself with a firearm and threatened the individuals with the weapon, Pepper said.
An officer reacted by shooting her, Pepper said.
That night, Rooks was in the midst of a mental health crisis and called 911 for help, according to a statement her family issued through their lawyer April 6.
