SC Paper Mill Now Facing Third Lawsuit Over Unhealthy Emissions

A South Carolina paper mill is now facing a third federal lawsuit from neighbors. The suit filed Tuesday says the plant s emissions are causing pollution and making them sick.
Like the two previous suits, this one also was filed at federal court in Rock Hill, South Carolina, and seeks class-action status and at least $5 million in damages from the company, New-Indy Containerboard. It also wants the plant shut down until the problem is fixed.
The suit was filed by Terri Kennedy of Indian Land, South Carolina. She lives seven miles northeast of the plant, which is along the Catawba River in York County. Kennedy says several times a week, the smell of rotten eggs from hydrogen sulfide and other pollutants enters her home. ....

Judge approves $65M Mountaire class-action settlement


The Delaware Superior Court has approved a $65 million class action settlement in one of the Mountaire environmental civil lawsuits. By settling, the Mountaire companies do not admit responsibility for the alleged groundwater or air contamination caused by their wastewater disposal activities — but the company agrees to pay people who may have been affected in a roughly 25-square-mile zone.
“To the class members, I hope the results here improve your life and make up for at least some of the losses you believe you’ve suffered. No settlement is never perfect, and that is especially true where, as here, liability was strenuously fought,” the Hon. Craig. A Karsnitz announced at the April 12 fairness hearing via Zoom. ....

A Delaware Superior Court judge has approved a $65 million settlement for Millsboro residents in a class-action lawsuit against poultry processor Mountaire. A Delaware Superior Court judge has approved $65 million in funds as part of a class-action settlement for Millsboro residents affected by groundwater pollution at Mountaire Farms’ Millsboro plant.
Judge Craig Karsnitz approved the settlement April 12 in Georgetown; in total, between Delaware and federal court settlements, Mountaire will have to pay $205 million. Of that, $65 million will go to class members, $120 million will be put toward improvements to the wastewater treatment plant, and $20 million will go for operations and mainte ....
