A Utah pharmacy CEO will spend the next three years on probation after he pleaded guilty to receiving misbranded chloroquine from China with the intent to sell it in the United States.
Daniel Kevin Richards, 37, of Sandy, Utah, will also be required to pay $10,000, a judge ruled in federal court Monday, according to the Utah U.S. Attorney’s Office.
As part of his plea agreement, Richards, the CEO of Meds In Motion, admitted to importing and receiving over 50 kilograms of misbranded and mislabeled chloroquine from China in April of 2020 a month after the coronavirus pandemic began. ....

SALT LAKE CITY – Daniel Kevin Richards, 37, of Sandy, Utah, pleaded guilty to receiving misbranded chloroquine from China with the intent to sell the drug in the United States. In the plea agreement, Richards admitted that, in April of 2020, he imported and received over 50 kilograms of misbranded and mislabeled chloroquine from China. Richards admitted that the chloroquine was falsely mislabeled as “Boswellia Serrata Extract” and that the drug was not manufactured and prepared by an establishment registered as a drug manufacturer with the Food and Drug Administration. Additionally, the labeling on the drugs failed to bear adequate directions for use as required by federal law. At sentencing, Richards faces a maximum possible sentence of up to a year ....

SALT LAKE CITY The owner of a Utah pharmacy who made a deal to sell the state thousands of doses of hydroxychloroquine as a controversial treatment for COVID-19 admitted in federal court Friday that drugs he bought from China were improperly branded.
Daniel Kevin Richards, the CEO of Draper-based Meds in Motion, pleaded guilty to one misdemeanor count of receipt of misbranded drugs in interstate commerce in U.S. District Court.
Richards received 50 kilograms of chloroquine and more than 500 kilograms of hydroxychloroquine around April 8, 2020, according to court documents. The product was falsely labeled as boswellia serrata extract, a resin taken from the bark of the boswellia tree grown in India, North Africa and the Middle East used to treat inflammation. ....
