Michael Dunn's lawyers file appeal, say judge erred in denying immunity


Dunn’s legal team filed an appeal earlier this month with the Florida Second District Court of Appeal. The lawyers, James R. “Rusty” Franklin of Bartow and Mark O’Mara of Orlando, are asking the court to set aside Jacobsen’s ruling and dismiss the charge.
A three-judge panel will review the petition and rule on it. Franklin said that will likely take six to nine months.
The deadly encounter occurred on Oct. 3, 2018, when Dunn was working at Vets Army Navy Surplus in Lakeland, where he was a general manager. Dunn, now 50, fatally shot Lopez, a homeless man, after Lopez seized a hatchet that was for sale and began to leave the store without paying for it. ....

Judge mulls bid to dismiss murder charge against Michael Dunn


A judge will soon decide whether former Lakeland City Commissioner Michael Dunn faces a trial for fatally shooting a man at a store in 2018.
Dunn appeared in court Friday for a hearing on his legal team’s claim that he acted properly under Florida’s “stand your ground” law and that a second-degree murder charge against him should be dismissed. If Circuit Court Judge Donald Jacobsen rejects the defense motion, Dunn will face a trial.
The fatal shooting occurred Oct. 3, 2018, when Dunn was working at Vets Surplus, the Lakeland business where he worked as general manager. Christobal Lopez, a homeless man, entered the store, seized a hatchet that was for sale and hid it in his pants, according to reports from the Lakeland Police Department. ....

Judge denies ex-Lakeland commissioner's bid to dismiss murder charge


A judge has denied a motion to dismiss a murder charge against former Lakeland City Commissioner Michael Dunn.
Thursday’s order from 10th Judicial Circuit Judge Donald Jacobsen means Dunn will face a trial in the 2018 fatal shooting of a suspected shoplifter, barring a successful appeal.
Jacobsen issued an eight-page order Thursday morning, six days after presiding over an immunity hearing in Bartow. Dunn’s legal team asked Jacobsen to dismiss the charge of second-degree murder by invoking Florida’s “stand your ground” law, which says someone who commits a crime while acting in self-defense is immune from prosecution.
But Jacobsen rejected the defense’s argument. ....
