Arbitrator diversity matters for justice perceptions and realities

In a June 2021 research report, the American Association of Justice (AAJ) found that women and minorities filing legal claims are more likely to be forced into arbitration with a white male arbitrator who will decide their case.
This AAJ report notes that for the two largest providers of arbitrators in employment and consumer disputes, the arbitrators are 88 percent white and 77 percent male. The Supreme Court has repeatedly enforced agreements to arbitrate major legal disputes even when individual employees and consumers held little, if any, bargaining power to understand and challenge these efforts to circumvent court resolution by requiring a private arbitration decision. ....

In memoriam: Marcia Greenbaum, ILR '62 | Cornell Chronicle

After graduating from the ILR School in 1962, Marcia Greenbaum had an influential impact on arbitration and mediation practices across the nation and in Eastern Europe.
Known also for her wisdom, warmth, sense of humor, wit and
joie de vivre, Marcia died Jan. 19.
She is described in her obituary as “A true believer in mediation and arbitration techniques as a means of solving societal problems, and an advocate for using dispute resolution to prevent violence in schools as well as the workplace.”
“Marcia helped create dispute resolution systems for newly emerging countries in Eastern Europe, served on a panel focused on the contentious 1993 dispute between Continental Airlines and the Airline Pilots Association, and played an integral role in the path-breaking Arbitrator Development Program for Women,” according to her obituary. ....
