The Union government s 102nd amendment had taken away decisions (read powers) of awarding reservation to the Maratha community because of which the erstwhile Fadnavis government framed the SEBC Act which has been quashed by the Supreme Court, Chavan, who heads the state sub-committee on Maratha reservation, told a press conference.

Chavan said the SC has stamped on the fact that Maharashtra state has no right to award any such reservation after the 102 amendment in the Constitution.
With the Supreme Court on Wednesday striking down the Maharashtra law granting quota to Marathas in admissions and government jobs, state minister Ashok Chavan criticised former chief minister Devendra Fadnavis for passing the SEBC Act in 2018 without due rights . ....

SC strikes down Maharashtra law on grant of quota to Marathas: Here s all you need to know
The Supreme Court on Wednesday quashed the Maharashtra law granting reservation in jobs and admissions to academic institutions to Maratha community. The top court said it did not find any exceptional circumstance to justify exceeding the 50 per cent cap set by Indra Sawhney judgment.
A five-judge Constitution Bench headed by Justice Ashok Bhushan allowed no breach of 50 per cent ceiling to give more reservation, as it refused to consider reviewing Indra Sawhney verdict of 1992.
It also refused to refer the 1992 Mandal judgement, setting a 50 per cent cap on reservation, to a larger bench for reconsideration. A five-judge bench headed by Justice Ashok Bhushan concurred on three major issues framed during the hearing, and said that no exceptional circumstances or the case was made out by Maharashtra to breach the 50 per cent cap on reser ....

Supreme Court strikes down Maratha reservation
Maratha Reservation Case: The Supreme Court on Wednesday set aside the Bombay High Court order and stuck down the reservation to Marathas in government jobs and admissions in Maharashtra. The verdict was pronounced by a five-judge constitution bench headed by Justice Ashok Bhushan.
The court held that there were no exceptional circumstances justifying the grant of reservation to Marathas in excess of 50% ceiling limit as a Socially and Economically Backward Class.
Neither the Gaikwad Commission nor the High Court have made out any situation for exceeding the ceiling of 50% reservation for Marathas. Therefore, we find there are no extraordinary circumstances for exceeding the ceiling , the court held in the judgment. ....
