Protect governance system from NAB’s abuse of power against bureaucracy, IHC orders National January 19, 2021 ISLAMABAD: In the Nandipur judgment handed down by the IHC recently, the court underlined that it is in the public interest to protect the governance system from the arbitrary exercise or abuse of powers vested in NAB. Authored by IHC Chief Justice Athar Minallah, the judgment urged upon the need for striking a balance between safeguarding the legitimate interests and rights of the bureaucracy on the one hand and, on the other, achieving the objectives for which the NAB Ordinance of 1999 had been promulgated and the Bureau was established. ....
ISLAMABAD: Senior PML-N leader and former prime minister Shahid Khaqan Abbasi accused the government of blackmailing the National Accountability Bureau (NAB) chairman as well as the judiciary. Talking to journalists before appearing in the accountability court of Islamabad in connection with the proceedings in LNG terminal case on Friday, Mr Abbasi termed NAB chairman retired Justice Javed Iqbal an ‘aggrieved’ person. Mr Abbasi appointed Justice Iqbal as NAB chairman when he was prime minister. He said the PTI government also blackmailed the deceased judge of accountability court Arshad Malik to convict three-time elected former prime minister Nawaz Sharif, adding that on the one hand, the government was blackmailing judges and, on the other, ministers were demanding bribe from private companies. ....
National January 15, 2021 ISLAMABAD: Misuse of authority, no matter how grave and gross, does not constitute an offence under the National Accountability Ordinance (NAO) unless it involves mens rea [criminal intent] and conscious knowledge or a guilty mind, the Islamabad High Court (IHC) has ruled. Mere ‘misuse of authority’, no matter how grave or gross in nature, would not be sufficient to constitute an offence under section 9(a)(vi) [of the NAO] because the unambiguous language used by the legislature makes the existence of the other ingredients a precondition, the judgment handed in the Nandipur Power Project case stated while upholding the acquittal of Adviser on Parliamentary Affairs Babar Awan and former law secretary Justice (retd) Riaz Kayani by an accountability court. ....
IHC upholds Babar Awan’s acquittal in Nandipur case Top Story January 13, 2021 ISLAMABAD: The Islamabad High Court (IHC) on Tuesday upheld acquittal of Adviser to Prime Minister on Parliamentary Affairs Babar Awan and retired Justice Riaz Kiani in the Nandipur power plant corruption reference. A two-judge bench, headed by Chief Justice Athar Minallah, dismissed the National Accountability Bureau’s (NAB) appeals challenging an accountability court’s June 25, 2019 verdict of acquitting them in the case, a private news channel reported. The bench set aside the trial court’s verdict that dismissed an acquittal plea of former law secretary Masood Chishti, who is named as accused in the case, and exonerated him from all charges. ....
