In response to the United States Department of Agriculture’s filing explaining to the plaintiffs and the court that it is continuing setting up an embattled loan forgiveness program despite it being halted by injunctions in three separate lawsuits, plaintiffs in the Northern District of Texas lawsuit filed a sur-reply claiming that the USDA sending a letter would cause them injury.
The plaintiffs are a group of white farmers who claimed the loan forgiveness program through Section 1005 of the American Rescue Plan Act was discriminatory because only farmers of minority races, known as “socially disadvantaged farmers and ranchers” in the program, are eligible for the aid. At least five lawsuits have been filed in district courts against this program. ....

Tom Vilsack, secretary of the U.S. Department of Agriculture, filed a reply in a Northern District of Texas lawsuit on Tuesday to the preliminary injunction granted in favor of the plaintiffs. Vilsack explained that although the court, and at least two others addressing similar lawsuits, have halted the USDA program, it is continuing to take steps to set up the loan forgiveness program for farmers and ranchers of minority races.
The lawsuit was filed by Sid Miller and other white farmers and ranchers in Texas, they alleged that a debt relief program approved by Congress as part of the American Rescue Plan Act, discriminated against them based on race and breached federal laws and the U.S. Constitution. The court granted the injunction and class certification, noting that the requirements for both were met and that the plaintiffs were likely to succeed. ....

Tom Vilsack, Secretary of the United States Department of Agriculture (USDA), opposed a preliminary injunction on a loan forgiveness program for socially disadvantaged farmers, or farmers of minority groups, on Friday. The defendant supported the loan program and argued that it addresses a history of discrimination and that the claims from the five white farmers are not sufficient for the relief they seek.
The aid program, outlined in Section 1005 of the American Rescue Plan Act, was approved by Congress to give aid in the wake of the COVID-19 pandemic to “socially disadvantaged” farmers who “had been subject to decades of discrimination in (USDA) programs.” Vilsack’s response cited that farmers of minority races were more likely to be close to foreclosure and did not have as much access to previous USDA pandemic aid programs. ....
