SANTA FE – The state Supreme Court upheld a murder conviction Friday against a man who claimed a “warrior gene” made him predisposed to impulsive acts of violence.

In a unanimous decision, justices ruled that a lower court was justified in excluding evidence about a theory that lacks scientific reliability in the conviction of Anthony Blas Yepez by a jury for the death of 75-year-old George Ortiz of Santa Fe in 2012.
Defense attorneys say Yepez was incapable of forming the intent to deliberately kill, but expert testimony on the scientific claim was excluded in the pre-trial hearing phase.

NM Supreme Court issues official opinion on validity of state emergency health orders

The New Mexico Supreme Court on Monday issued a written opinion that explained its reasoning behind a bench ruling regarding state emergency public health orders. The high court ruled last summer that the state and the governor are legally allowed to issue emergency health orders without a formal rulemaking process. 
The court unanimously ruled that the state Department of Health and Gov. Michelle Lujan Grisham are granted, by the Legislature, the ability to issue orders limiting certain business activities. In this case, businesses were ordered to cease indoor dining during the COVID-19 pandemic. 
Last year a group of business owners challenged those orders, arguing that they were arbitrary and capricious and that the normal rulemaking process should be followed to implement such emergency orders.

SANTA FE — Supreme Court Justice Julie J. Vargas was sworn into office Monday.
Chief Justice Michael Vigil administered the oath of office to the justice during a ceremony in the Supreme Court courtroom. Family members of the justice were present.
Other Supreme Court justices, friends and judicial colleagues attended remotely through an audio-video connection. 
The governor appointed Justice Vargas to a vacancy created by the retirement of Justice Judith Nakamura.

Governor appoints UNM alumna to highest court in New Mexico


The Albuquerque native, and former Lobo, will succeed Justice Judith Nakamura.
“We are extremely pleased to learn that our alum, Judge Julie Vargas, has been selected by the governor to be the newest justice of the New Mexico Supreme Court. It is wonderful to see all the amazing things that our alums accomplish," said Sergio Pareja, School of Law dean
The governor selected Vargas from the list of candidates provided by the Judicial Nominating Commission after conducting multiple interviews.
“Judge Vargas has demonstrated her quality as a consistent and conscientious jurist,” Lujan Grisham said. “She is a fair, trustworthy and thoughtful representative of New Mexico’s judicial system, and I know New Mexico will benefit from her service now as a justice.”
