Partisan deadlock blocks Unlock Michigan initiative over emergency powers


Two Republicans on the four-member board voted to certify petitions deemed sufficient by the Bureau of Elections, which estimated more than 460,000 valid signatures were collected from Michigan voters. But Democrats voted against certification, citing questionable collection practices by paid circulation firms. 
Spokesperson Fred Wszolek said Unlock Michigan will appeal the canvasser decision through the state courts, likely within days. 
“There’s an unending conga line of Supreme Court precedent that they have one job to do, which is to approve the staff report” from the Bureau of Elections that recommended certification, Wszolek said. 
“I’m very tempted to seek sanctions and court costs from the two (Democratic) canvassers for this mess.” ....

Michigan Supreme Court doesn't weigh in on petition requirements


Lansing The Michigan Supreme Court avoided weighing in Tuesday on the constitutionality of hurdles imposed in 2018 by the GOP-controlled Legislature for petition efforts to initiate ballot proposals.
In a 4-3 decision, the state s high court ruled that one group s suit disputing the requirements was moot because the campaign had ended its petition effort and that the House and Senate lacked standing to challenge an opinion by Democratic Attorney General Dana Nessel that deemed their policy unconstitutional. 
The law in question says a statewide petition campaign may not get more than 15% of its signatures from one of the 14 congressional districts. Petitions must include check boxes indicating whether a gatherer is paid or not. ....

MI Supreme Court Rules Non-Public Schools Can Get State Funds

A deadlock on the Michigan Supreme Court has effectively reversed a ban on any taxpayer funds going to private and religious schools. The decision allows state funds to go toward helping schools comply with health and safety mandates.
 
Religious organizations cheered the decision, while public school administrators and teachers unions won’t rule out a renewed challenge. 
Republican-led legislatures approved nominal funding in two state budgets to test the limits of a 1970 voter-approved amendment to the Michigan Constitution. The amendment includes this provision:
 
No public monies or property shall be appropriated or paid or any public credit utilized, by the legislature or any other political subdivision or agency of the state directly or indirectly to aid or maintain any private, denominational or other nonpublic, pre-elementary, elementary, or secondary school.
