Meet the federal judge who overturned California's decades-old assault weapons ban

“Like the Swiss Army Knife, the popular AR-15 rifle is a perfect combination of home defense weapon and
homeland defense equipment,” US District Judge Roger T. Benitez wrote.
In another section, he downplayed the risk of an assault rifle being used in a mass shooting as an “infinitesimally rare event.” He added: “More people have died from the Covid-19 vaccine than mass shootings in California.”
Benitez has consistently ruled against California’s gun control laws by using these sorts of attention-grabbing analogies. In a March 2019 ruling against the state’s limits on large-capacity magazines, Benitez opened with the dramatic stories of three women who ran out of ammo while shooting home intruders none of which took place in California. In a page 5 footnote, he cited Kristallnacht, the 1938 night of anti-Semitic violence in Nazi Germany. ....

Assault rifles have been repeatedly used in major mass shootings, such as the supermarket shooting in Boulder and in the deadly Christchurch mosque attack in New Zealand in 2019. Yet, pro-gun lobbyists are pushing to legalize their use, with California becoming the latest domino to fall. Benitez has given the state plenty of time to appeal the decision, which it is expected to do.

Who is Roger Benitez?
Born in Havana, Cuba, Benitez emigrated to America as a child. He did his schooling in El Centro before earning an Associate in Arts degree from Imperial Valley Community College in 1971. Benitez also attended San Diego State University (1974), before obtaining a JD from Western State University College of Law (1978). He then joined a private law firm and was engaged in private practice for nearly 20 years. D ....

Jim and Carol Spencer’s memories of riding the train as youngsters was just one of the inspirations for setting up a miniature railroad in their San Diego Country Estates backyard.
While growing up in Chicago, Carol often traveled by train with her sister to visit their grandfather in Topeka, Kan. Long before he met his future wife, Jim also made trips to visit his grandparents in Topeka. ....
