Aspen-area restaurants seek suspension of Pitkin County's Red level order

Attorneys for a newly formed group of Aspen restaurants raced Thursday to file court papers seeking injunctive relief from a Pitkin County Board of Health order that takes effect Sunday banning indoor dining.
The complaint asks for a court order to suspend or repeal the Red-level order passed by the health board Monday. The organization also filed a motion for a temporary restraining order intended to keep the existing Orange-plus-plus health restrictions in place until judicial review of the county’s Red order is completed. ....

Famed con man who lived in Ajax shack arrested again in Aspen


A notorious con man and lifelong thief caught four years ago living in a well-appointed cabin he built on Aspen Mountain is back in town and back in trouble.
James Hogue, 61, was arrested Monday by Aspen police officers investigating a burglary and charged with parking illegally and stealing power from a nearby apartment building, said APD Sgt. Mike Tracey. Hogue was not taken to jail and, instead, issued a summons for trespassing and tampering, which are low-level offenses.
Aspen police continue to investigate the burglary, which took place inside the parking garage of an apartment building in the 200 block of East Cooper Avenue, Tracey said. ....

Pitkin County admits fault in open meetings case


Admitting its failure to comply with the state’s Opening Meetings Law, the Pitkin County government settled a lawsuit where its commissioners were accused of doing public business in private.
The agreement was reached in December. It came after Pagosa Springs attorney Matt Roane filed a court complaint in late October saying the county failed to broadcast the Board of County Commissioners adopting a motion Oct. 20.
That day, commissioners held a public work session that started at 1 p.m. and was streamed on the county’s website and Grassroots TV.
Ahead of the work session, the BOCC had been in an executive session closed to the public. Going into the executive session, however, required a motion and vote from the BOCC. That process is open to the public, but it wasn’t at the October meeting because the county did not broadcast it. ....

Litigation settles over harassment after 2018 bear killing in Snowmass

A Snowmass homeowner under a no-contact order with relatives of a hunter who legally killed a bear also has agreed to a cash settlement with the family who sued him in federal court.
“The only thing I can say is the parties have reached a confidential agreement,” said Sean Breen, an Austin, Texas, attorney who also has a home in Snowmass.
Breen represented Andrew Huck, his wife, Javiera Francisca Valenzuela Yuraszeck, and their two young sons in a civil case against Thomas Andersen. Their suit accused Andersen of repeatedly threatening and harassing the family after Huck, on Sept. 7, 2018, shot and killed a black bear on a Brush Creek Ranch property next to Andersen’s residence. ....

Aspen marijuana shop, neighbors in legal flap


An Aspen condominium association’s attempt to ban upper-floor marijuana dispensaries and other retail uses is being legally challenged by the owner of three of the downtown building’s commercial units, one of which houses a pot shop.
The condo association, however, maintains certain second-floor retailers aren’t compatible with the building’s third- and fourth-floor residential dwellers who expect a certain level of decorum.
Following unsuccessful mediation, the lawsuit by Douglas Tomkins against Aspenhof Condominium Association is the latest turn in a years-long disagreement between unit owners and the operators of certain retailers at 520 E. Cooper Ave. Known as the Aspenhof, the building comprises 10 residential units and nine commercial units. ....
