Over the partial concurrences and partial dissents of two of its
three Republican commissioners, the Federal Energy Regulatory
Commission (FERC) yesterday issued a Policy
Statement in Docket No. AD20-14 announcing that it would
entertain filings by eligible entities in certain parts of the
country to incorporate state-sponsored carbon prices in wholesale
markets. The action follows a September 2020 carbon pricing
technical conference and a Proposed Policy Statement that was issued on
October 15, 2020 under then-Chairman Neil Chatterjee, another
Republican appointee, who was replaced as Chairman less than three ....

Things Looking Up for Renewable Resources at Federal Energy Regulatory Commission | Bracewell LLP

At the Federal Energy Regulatory Commission (“FERC” or “Commission”), President Joseph Biden selected Richard Glick, one of two Democratic commissioners on the five person commission, as Chairman.  The Chair sets FERC’s agenda, so even without a tie-breaker vote or a majority of Democratic Commissioners (the situation until one of the Republican Commissioners departs), Chairman Glick will have significant influence over FERC policy for 2021.  As is most relevant for
Sustainability Bulletin readers, FERC covered a lot of ground on renewables issues in 2020 and we expect more of the same for 2021.  Chairman Glick’s dissents in 2019 and 2020 provide a roadmap for what we may see from FERC on renewables issues in 2021 and beyond.  Below, we highlight a few material FERC renewables developments in 2020 and look ahead to possible developments in FERC’s approach when similar issues queue up before FER ....

On December 17, 2020, FERC issued an order concluding its review of the index level used to determine annual changes to oil pipeline rate ceilings, establishing an index level of Producer Price Index for Finished Goods plus 0.78% (PPI-FG+0.78%), and also issued a Withdrawal of Proposed Policy Statement on Oil Pipeline Affiliate Contracts, the latter of which drew a dissenting opinion from Commissioner Richard Glick.
Rather than making cost-of-service filings, oil pipelines adjust their rates to applicable ceiling levels under an indexing methodology that FERC reviews every five years. On June 18, 2020, FERC issued a Notice of Inquiry initiating its review to establish the oil pipeline index for the July 1, 2021 to June 30, 2026 time period. FERC proposed an index level of PPI-FG+0.09% and requested comments on its proposal and any alternative methodologies for calculating the index level. In its December 17, 2020 ....
