ISLAMABAD (Dunya News) - The Supreme Court (SC) while hearing the Presidential Reference for holding Senate election through open ballot remarked that election under current system would promote horse trading, an amended should be made in the Article 63A to punish those who vote against the party.
The Court remarked that if there is no disqualification for voting against the party, then what is the problem. During the hearing, Chief Justice of Pakistan (CJP) Gulzar Ahmed remarked that the conduct of Senate election under the existing system meant that the buying and selling of members would continue. ....

ISLAMABAD: Chief Justice of Pakistan Justice Gulzar Ahmed has said that if the government doesn’t withdraw the Presidential Reference, the apex court will give its advice.
A five-member larger bench of the apex court, headed by Chief Justice of Pakistan Gulzar Ahmed and comprising Justice Mushir Alam, Justice Umar Ata Bandial, Justice Yahya Afridi and Justice Ijazul Ahsan, resumed the hearing in the Presidential Reference.
Continuing his arguments, Attorney-General Khalid Javed submitted that the political parties earlier favouring holding of Senate elections through an open ballot were now opposing and creating hurdles to the process.
“It is the obligation of the federal government that to ensure transparency in the elections, it is the desire of the government to hold the Senate elections through an open ballot, however, the market has been set for selling the horses for the elections.” ....

Senate elections: Govt moves SC to ruin Senate's pitch under garb of transparency

ISLAMABAD: Former chairman Senate Mian Raza Rabbani Thursday said that under the garb of so-called transparency of the vote, the federal government wants to destroy the pith of the Senate, which is enshrined in Article 59, Constitution, 1973, wherein it states that the Senate Elections will be held on ‘proportional representation’ and a ‘single transferable vote’.
“The doing away of this principle will also deprive the nationalist and religious parties of being a part of the mainstream of the Federation,” he said in a statement on Thursday.
Rabbani said as the federal government does not enjoy a majority in Parliament to amend the Constitution, therefore, it is trying to hide behind the cloak of the Supreme Court (SC). He said the Article 186 cannot be and is not a substitute to Article 238 and 239, which provide the procedure for an amendment in the Constitution, 1973.
