The Mississippi Supreme Court has heard arguments in a case that not only decides the fate of a voter initiative authorizing a medical marijuana program in Mississippi but may well decide the future of the state’s entire voter initiative process.
In the 2020 elections, Mississippi voters overwhelmingly approved a voter initiative authorizing a medical marijuana voter initiative as outlined in Initiative 65 over the express objections of the majority of legislative leaders.
The voters gave Initiative 65 a 73.7% approval while giving the legislative alternative Initiative 65A only 26.3% of the vote. The pro-marijuana initiative outpolled Republican incumbent President Donald Trump by some 20 percentage points with state voters – even outpolling the state’s 72.98% decision to change the state flag. ....

Law360 (April 14, 2021, 7:13 PM EDT) Although they barely mentioned marijuana, a few Mississippi Supreme Court justices indicated Wednesday they are likely to vote to throw out the ballot measure that legalized the drug for medical uses but it was unclear if a majority would go in that direction.

Mississippi Supreme Court to Hear Challenge to Medical Marijuana Initiative
The Mississippi Supreme Court is set to hear arguments Wednesday in a lawsuit that challenges the state initiative process and seeks to block development of a medical marijuana program.
Voters in November approved Initiative 65, which requires the state Health Department to establish a medical marijuana program by the middle of this year.
A lawsuit by Madison Mayor Mary Hawkins Butler is trying to block the program by arguing that Mississippi’s initiative process is outdated and Initiative 65 should not have been on the ballot.
The state constitution says petitioners must gather an equal number of signatures from five congressional districts that Mississippi used during the 1990s. The state dropped from five congressional districts to four after the 2000 Census, but the constitution’s language about initiatives was not updated. Mississippi medical marijuana hangs in balance with Supreme Court

The medical marijuana program Mississippi voters approved in November, set to begin in August, hangs in the balance with the state Supreme Court, which heard oral arguments about Initiative 65 on Wednesday.
The arguments have nothing to do with medical marijuana or the program voters enshrined in the state constitution, but on procedural issues whether Initiative 65’s placement on the ballot through a signature petition was constitutionally proper.
Chief Justice Michael Randolph indicated the nine-judge court would issue an opinion as quickly as possible and, “I know many people are waiting on this.”
“It’s in the judges’ hands now,” said Madison Mayor Mary Hawkins Butler, who filed a Supreme Court challenge to Initiative 65 just days before voters approved it on Nov. 3. “This is one of those defining moments for our state.
