NPC issues guidance on digital tools competitiveness

The National Privacy Commission (NPC) has issued its first guidance on the adoption of tools in the digital economy that will unlock potentials of domestic enterprises to tap the ASEAN market.
In a statement, NPC said the first guidance harmonizes harmonize data management and cross-border transfer standards across the Association of Southeast Asian Nations (ASEAN), a move that will help Philippine businesses unlock more gains in the fast expanding digital economy across the ASEAN.

These tools, namely the Model Contract Clauses (MCCs) and the Data Management Framework (DMF), “are vital… for ASEAN businesses to use in their data-related business operations and help build trust, transparency, and accountability,” according to NPC Advisory No. 2021 – 02 dated June 28, 2021. ....

A couple of days before Christmas, the National Privacy Commission (NPC) managed to release one more policy for 2020: NPC Circular 2020-03. The issuance basically sounds the death knell for Data Sharing Agreements (DSAs), which are a key feature of the Commission’s very own Data Privacy Accountability and Compliance Checklist.
For the uninitiated, DSAs are contracts between two or more entities sharing, transferring, or disclosing personal data to or between one another, while acting as personal information controllers (PICs). As PICs, they each determine the purpose and means of their respective data processing activities. They may agree on the general parameters of the data transfer, but no one really gets to tell the other what to do with the data. For this reason, DSAs are not used in transactions between principals and service providers. ....

On 22 January 2021 the Association of Southeast Asian Nations (ASEAN) Digital Ministers Meeting approved the ASEAN Data Management Framework (the DMF) and the Model Contractual Clauses for Cross Border Data Flows (the MCCs). The DMF initiative, led by Singapore, has the objective of developing a regional policy framework for data protection in the ASEAN economy, with a particular focus on the internet, a growth sector for ASEAN that is expected to exceed US$240 billion by 2025. It is clear that the DMF has its primary policy focus on economic development, as was the case with the 2004 APEC Data Privacy Framework, the 2016 ASEAN Framework on Personal Data Protection, and other regional data protection initiatives.
