Federal Environment Minister Sussan Ley will appeal a Federal Court order that she has a duty of care to protect young people from the impacts of greenhouse gas emissions.
In a statement made following Thursday’s judgement of the Federal Court, Ley said that she had ‘formed the view there are grounds on which to appeal’ and that she ‘has now instructed the department to lodge a notice of appeal’.
The decision related to legal proceedings commenced by a group of high school students seeking to pre-empt the Environment Minister issuing approval to Whitehaven Coal to expand the Vickery Coal Mine.

Teenagers behind a landmark Federal Court ruling have criticised the Environment Minister and the Morrison government for the “embarrassing” decision to appeal against having a duty of care to protect young Australians from potential harm.
Earlier this week, the Federal Court ruled in favour of eight young Australians who argued that the government must protect them from foreseeable future harms of climate change, particularly the “catastrophic” damage that could be done if projects that contribute to an increase in the earth’s temperature are permitted to proceed.
Back in 2002 the then-treasurer, Peter Costello, had a problem. The combination of privatising Telstra and the arrival of the first mining boom meant he had lots of money to spend and no excuse not to spend it. So, the intergenerational report was born.
Rather than focus on the fact that Australia was one of the richest countries in the world, that the mining boom was driving record government revenues and the government was sitting on tens of billions after selling off profitable assets, the IGR helped Peter Costello to convince the public that rather than invest in health or education, or support Australians in need, we had an obligation to look to the future and ensure that the budget was in good shape 40 years down the track.
