Man gets 30 years for Butte shooting, faces 80 for Billings homicide

A judge sentenced a man to 30 years at the Montana State Prison on Thursday for shooting a man at McGruff Park in Butte, but he faces up to 80 years when sentenced next week for killing a man in Billings a few days prior to the Butte crime.
Colby Allen Clark, 22, of Billings, pleaded guilty to deliberate homicide in the Yellowstone County case and is to be sentenced for that Wednesday. Prosecutors are recommending 80 years, to run concurrently with the Butte sentence.
In the Butte case, Clark ultimately pleaded guilty to assault with a weapon and criminal endangerment and District Judge Kurt Krueger sentenced him to the maximums for both and made them run consecutively. ....

HELENA (AP) — A lawsuit has been filed to challenge a legislative proposal to change the way Supreme Court justices would be elected in Montana.
A Roman Catholic nun, a former court clerk and three former state lawmakers are among those challenging the constitutionality of a bill the legislature passed to ask Montana voters if they want to elect Supreme Court justices by district, rather than on a statewide basis.
The complaint, filed on May 6 in Butte, asks District Judge Kurt Krueger to declare the bill unconstitutional and to prevent Secretary of State Christi Jacobsen from certifying the referendum for the November 2022 ballot. ....

HELENA, Mont. (AP) A lawsuit has been filed to challenge a legislative proposal to change the way Supreme Court justices would be elected in Montana.

MT lawmakers, Supreme Court battle in pending separation of powers battle


HELENA, Mont. - The Montana Supreme Court is under investigation by state lawmakers.
After Governor Greg Gianforte signed SB 140 into law, allowing him to appoint judges to the district courts and state Supreme Court instead of going through a judicial nominating commission. Those judges would still have to be confirmed through the State Senate, but that is not the biggest issue at hand.
The investigation revealed Supreme Court Chief Justice Mike McGrath told the governor he was against this bill. Gov. Gianforte signed it anyway and almost immediately; this bill was challenged in the Supreme Court. McGrath recused himself from hearing this challenge because he had already made his opinion known. ....

Republican leadership at the Montana Legislature is defying a Supreme Court order telling them to halt their efforts to obtain judicial-system emails.

HELENA — The attorney general’s office late Monday told the Montana Supreme Court that Republican legislators will not comply with the court’s order to halt their attempts to acquire and publicize internal emails from the state judiciary.
In a letter to Supreme Court Justice Jim Rice, Lieutenant Attorney General Kristin Hansen said the Legislature “does not recognize this court’s order” and will not allow the court to interfere with legislative investigation of “troubling conduct of the judiciary.” ....
