Supreme Court says circuit court rightfully dismissed Xenia Hotel tax assessment appeal


CHARLESTON The West Virginia Supreme Court of Appeals affirmed that a lower court did not have jurisdiction in a lawsuit involving Xenia Hotels & Resorts 2019 tax assessment.
Xenia owns the Charleston Marriott property in Charleston and filed a notice of intent to file a protest in February 2019 before the Kanawha County Board of Commissioners, which was sitting as the Board of Assessment Appeals, according to the March 23 memorandum decision.
Xenia was challenging the valuation of the property from the 2019 assessment and submitted that the appraised value was in excess of the market value.
However, the Kanawha County Assessor denied the petitioner’s request for review of the property appraisal because the petitioner’s challenge was untimely. The parties were scheduled to go before the commission on Oct. 10, 2019, but Xenia did not show up to the hearing and the appeal was marked as withdrawn. Senate OKs amended intermediate court bill, which now goes to governor


CHARLESTON – A bill that would create a new intermediate appellate court is headed to the governor s desk.
On April 1, the state Senate concurred on amendments made in the House of Delegates to Senate Bill 275. The vote was 21-12. That followed the House passing the amended bill by a 56-44 vote March 30.
Instead of the Senate plan for two districts, the House version only has one district. That also trims the estimated initial budget from nearly $8 million to about $3.6 million and the continuing annual cost from about $5.7 million to $2.1 million.
The Senate also had the judges serving 12-year terms, like those of the state Supreme Court justices. The House version changes that to 10-year terms. ....

Supreme Court rules lawsuit was rightfully dismissed


CHARLESTON The West Virginia Supreme Court of Appeals ruled that a lawsuit against the Chemours Company was rightfully dismissed because the claims had already been adjudicated in a previous lawsuit.
We have analyzed the facts and the parties’ legal arguments under our considerable body of case law, which stretches back more than a century, and upon careful review of the briefs, oral arguments, and the appendix record, we affirm the judgment of the circuit court, the majority opinion states.

Justices hear arguments regarding alleged state employee wage payment shortfalls


CHARLESTON – The state Supreme Court will decide whether to remand a case involving state employees who claim they were shortchanged when the state switched from twice monthly to biweekly pay.
The petition was heard March 16. The petitioners – Lisa Wilkinson, Heather Morris, Kathryn A. Bradley, Pamela Stumpf and Lula V. Dickerson – are five state employees. But the case could affect up to 40,000 public employees. The respondents are Gov. Jim Justice, Auditor John B. McCuskey, former Treasurer John Perdue, Secretary of State Mac Warner, Attorney General Patrick Morrisey and state Supreme Court Chief Justice Evan Jenkins.
During the March 16 oral arguments, attorney Mike Ranson presented the case for the petitioners. He argued that the employee simply were not fully paid in the 2017 calendar year because of the state’s switch from twice monthly pay to biweekly. Bryan R.
