Broadband industry sues New York over $15 price cap


On Friday, a collection of industry groups filed suit against New York State Attorney General Letitia James, arguing states can t regulate broadband services. The suit contends the Federal Communications Commission (FCC) ruled in 2018 that broadband is an interstate information service that can t be regulated as a common-carrier service.
The Rate Regulation expressly seeks to set the rates and speed of an interstate communication services, it said. No state has ever successfully engaged in such regulations.
The FCC s 2018 ruling under chairman Ajit Pai came after a public consultation fraught with controversy. It was hotly contested because it changed the Commission s view of broadband communications from a common-carrier utility to a luxury, relaxing its control over broadband ISPs and effectively overturning federal net neutrality rules. ....

Last month, New York passed a law as part of its budget plan that would require ISPs in the state to offer low-income residents an option for $15-a-month broadband plans. The plan would be for 25 megabits per second (Mbps) download speeds and 10 Mbps upload speeds.

The plan would specifically be for residents who met certain criteria, like being eligible for the Supplemental Nutrition Assistance Program (SNAP) or Medicaid, among other things.
Experts told the Daily Dot at the time that New York’s plan was a “substantial step forward in addressing the challenge of broadband affordability that so many families around the country are confronting.” ....

Just about everyone saw this coming. A group of broadband industry associations have sued New York in an effort to stop the state’s recent mandate to provide a $15 tier for broadband service to low income residents. Plaintiffs in the suit include the New York State Telecommunications Association (NYSTA), CTIA, USTelecom, NTCA, and ACA Connects, among others.
The New York mandate was passed last month as a part of a state budget bill, and gave ISPs operating in the state of New York 60 days to offer a $15 broadband plan to households that include a member eligible for discounted school lunches or receive Supplemental Nutrition Assistance Program (SNAP) benefits, commonly referred to as food stamps. On Friday, numerous telecommunications associations filed a complaint in the Eastern District of New York against New York Attorney General Letitia A. James over a state law that purportedly seeks to regulate the rates and speeds of interstate communications, from which the plaintiffs argued New York is precluded under federal law.
According to the complaint, internet access is generally provided through broadband, which “ ‘transmits data at much higher speeds’ than preexisting technologies, such as dial-up connections provided over local telephone facilities.” Additionally, the plaintiffs noted that broadband is considered “an interstate information service that is subject to a federal regulatory framework, under which a combination of mandatory disclosures, competition, and federal and state enforcement of preexisting laws benefit consumers.” The plaintiffs asserted that the Federal Co ....
