For nearly two decades, sides have battled over plans by Champlin’s Marina to expand on Block Island, and on Thursday, the legal wrangling took yet another major turn.
In a 40-page filing with the Rhode Island Supreme Court, the Rhode Island Attorney General s office argued, At every phase over the past seventeen years, all of the parties with an interest in the Champlin’s application have had opportunities to seek appellate review of the CRMC’s [Coastal Resources Management Council] decisions with respect to this application – until now. The CRMC and Champlin’s mediated resolution circumvented this open and required process where any aggrieved party could be heard.” ....

Attorney General argues for denial of Champlin's marina expansion pact

PROVIDENCE Attorney General Peter F. Neronha is urging the Rhode Island Supreme Court to reject a settlement approved by state coastal regulators that allows for the expansion of a marina on Block Island that has been the subject of heated dispute for nearly two decades.
In a motion that excoriates the state Coastal Resources Management Council, Neronha’s office argues that the memorandum of understanding agreed to by the council and the owner of Champlin’s Marina behind closed doors and without public review is invalid.
“Given the long and complicated history associated with the Champlin’s application, it is troubling that now, before this final stage of review, the CRMC, in partnership with only the applicant, has moved this Court to allow a form of the very expansion that has been at issue these past seventeen years and which has been repeatedly rejected by the CRMC after opportunities for hearings and the review of evidence in the record,” says the motion ....

Former Rhode Island Supreme Court Justice Frank Williams is questioning Attorney General Peter Neronha s jurisdiction and motivation to petition the Rhode Island Supreme Court to intervene in a mediated case involving a controversial Block Island marina s proposed expansion.
Williams served as the mediator in the case between the marina Champlin’s Realty Associates and the Coastal Resources Management Council (CRMC).
In the motion filed with the Rhode Island Supreme Court on Monday, Neronha asked to intervene in the proceedings to address concerns about a recent closed-door mediation between the CRMC and Champlin’s that would allow for a marina expansion. Opponents of Block Island's Champlin's Marina angered over 'backroom deal'

NEW SHOREHAM Opponents of a controversial marina expansion are furious about what they call a “secret backroom deal” that froze them out of an agreement to settle a 17-year-old case.
They point the finger at the state’s Coastal Resources Management Council and retired Supreme Court Chief Justice Frank J. Williams, who helped broker the agreement.
“This is a lawless attempt to fix litigation. There’s no other way to describe it,” said R. Daniel Prentiss, the attorney representing the town of New Shoreham and three environmental groups on Block Island. The opponents have raised more than half a million dollars since 2003 to fight the proposal by Champlin’s Marina on Great Salt Pond. ....
