As a US-returned young Pakistani who got caught up in law I had this unshakeable faith in democracy and civilian constitutional rule. It was because of this feeling that one supported the lawyers’ movement and eventual ouster of the dictator but what do we have to show for it. A hybrid system less transparent that Myanmar’s short-lived “democratic” stint? A country where one cannot breathe freely because of fanatic religious groups that target minorities and where the space for reasonable discourse has been shrinking since the assassination of Salmaan Taseer? This is a shamelessly populist majoritarian electoral democracy at best and that too in name. We know where the real shots are called. It is a strange partnership between the militablishment and civilian rulers of which nothing good can come out. The whole thing is a farce. The civilians play musical chairs while you know who plays the music. ....

There is a growing debate that the discretionary powers of the Chief Justice of Pakistan should be structured and regulated to ensure more transparency in the affairs of the Supreme Court. The CJP currently enjoys unfettered discretionary powers to constitute benches, ‘fix’ cases and initiate public interest proceedings under Article 184 (3) of the constitution. Likewise, being Chairman Judicial Commission of Pakistan (JCP) as well as Supreme Judicial Council, the CJP has vast discretionary of the powers in the process regarding judges appointments and their removal under Article 209 of constitution. ....

Prime Minister Imran Khan’s latest U-Turn on opening trade with India illustrates why Pakistan cannot fulfil its leaders’ stated goal of an economy-oriented foreign policy without moving away from the Islamist ideology that currently defines Pakistani nationalism.
Imran Khan’s Cabinet linked trade with India to the resolution of the Kashmir dispute on terms favorable to Pakistan, rejecting an earlier decision by the Cabinet’s Economic Coordination Committee to import sugar and cotton from India. Given that India has not given in to Pakistan’s demands on Kashmir after 72 years, multiple wars, and Pakistan-backed terrorism, linking the opening of trade to the Kashmir issue runs against the logic of geo-economics. ....
