Employers Beware – New Jersey Is Signaling That the State Is Ready for Enforcement of Its New Worker Misclassification Laws

On July 8, 2021, Governor Murphy signed four bills regarding worker misclassification, increasing penalties and enforcement against businesses that misclassify workers as independent contractors. These laws amend and expand upon the worker misclassification laws previously enacted in January 2020, which we addressed in our prior alert (the “January 2020 Laws”). The January 2020 Laws enhanced liability for managers, making them jointly and severally liable for wage violations, and made posting violations and retaliation for misclassification complaints a disorderly persons offense. Further, these laws created new administrative requirements, permitted “stop-work orders,” provided back pay to improperly classified workers of up to 5% of their prior year’s gross earnings, and increased fines t ....

On October 29, 2020, the Commonwealth Court of Pennsylvania set a new precedent by holding that Pennsylvania’s Medical Marijuana Act (MMA) did not safeguard a medical student from her college’s zero-tolerance drug policy. Over the past month, Pennsylvania courts have issued a series of decisions clarifying employee rights for medical cannabis patients one related to unemployment compensation and others related to private rights of action under its medical cannabis statute. Most recently, in
Pittsburgh Water and Sewer Authority v. Unemployment Compensation Board of Review, the Pennsylvania Commonwealth Court affirmed a decision by the Unemployment Compensation (“UC”) Board of Review finding that Terrance Suber, a former employee, was entitled to UC benefits following his termination in 2019 for a positive drug test.
