Law360 (July 14, 2021, 10:19 PM EDT) A Florida appeals court on Wednesday reversed a $10 million judgment won by the daughter of a smoker who died of lung cancer in a case against R.J. Reynolds Tobacco Co., finding that her attorney had been warned in four previous instances not to make inflammatory arguments at trial.
A Fourth District Court of Appeal panel said objections levied by the tobacco giant should have been sustained when Deborah Neff s attorney Scott Schlesinger told the jury that R.J. Reynolds and Philip Morris USA Inc. ran an enterprise of death and that their defense was the last refuge of the scoundrel. . ....

Reynolds Tobacco Co. and Philip Morris USA Inc. urged a Florida appeals court Tuesday to reverse a $10 million judgment for the daughter of a smoker who died of lung cancer, arguing that her attorney made improper inflammatory remarks to the jury at the close of trial.
R.J. Reynolds attorney Val Leppert told a Fourth District Court of Appeal panel that Deborah Neff s attorney Scott Schlesinger made a number of remarks in his closing argument meant to inflame the jury, such as calling the tobacco companies immoral evildoers and their defense the last refuge of the scoundrel. ....

(Legal Newsline) - A plaintiff lawyer who compared cigarette manufacturers to Nazis and his client to a torture victim in George Orwell’s novel “1984” “went way over the line” but not far enough to require a new trial, a Florida appeals court said in a decision urging judges to keep a tighter lid on inflammatory closing arguments.
Altria’s Philip Morris unit moved for a mistrial after attorney Scott Schlesinger referred to the movie “Schindler List” in closing arguments in a lawsuit by the estate of the late Sheila Kaplan, a lifelong smoker who died of lung cancer. The jury awarded $5.1 million, including $2.97 million in punitive damages. The appeals court let the verdict stand, saying that while Schlesinger’s arguments were improper they were also apparently unsuccessful, since the jury awarded less than he was seeking. ....
