Former employee says nursing home discriminated against him

HUNTINGTON A former employee says Wayne Nursing & Rehabilitation Center discriminated against him and caused him to resign from his employment.
Randall Fetty began working for the nursing home in 2016 as a maintenance supervisor and suffered a stroke on Feb. 27, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.
Fetty claims he applied for and was approved for Family Medical Leave Act (FMLA) leave and used that leave over several months. He was told on June 1 that he needed to supply a return to work release from the doctor who had certified his FMLA application, but that doctor was out of town and without that signature, he was unable to return to work.  ....

Wayne candidate asks court to intervene over House seat


WAYNE — A former candidate is seeking legal action against the Wayne County Republican Executive Committee, claiming actions to replace former Del. Derrick Evans violated the law.
Jason Stephens, a former Republican candidate for the West Virginia House of Delegates for the 19th District, is asking the West Virginia Supreme Court to stop the “improper and illegal” replacement of Evans, according to a prepared statement from Stephens.
Stephens claims that after the Wayne County committee violated procedures to replace Evans — who resigned after he was charged with illegally entering the U.S. Capitol with a mob of Donald Trump supporters Jan. 6 — the West Virginia State Republican Executive Committee intervened to correct the situation, but ultimately ended up violating protocol as well. ....

County officials say employee was fired over performance, not retaliation for taking COVID-19 precautions


WAYNE — Wayne County officials responding to a federal lawsuit said a former employee was fired based on her performance, not in retaliation for her cautiousness during the COVID-19 pandemic.
Former Wayne County Sheriff Department employee Patricia Romans filed a lawsuit in December against the Wayne County Commission and sheriff Rick Thompson, accusing them of discrimination and retaliation for taking leave under the Family and Medical Leave Act.
Romans said she was fired after asking the sheriff’s office to follow CDC recommendations for COVID-19 precautions, such as mask wearing.
In their response, the defendants’ attorneys Wendy Greve and Jacob Layne, of Pullin, Fowler, Flanagan, Brown and Poe PLLC, said the “Plaintiff failed to attend work and her performance was otherwise unsatisfactory and she had no reasonable expectation of continued employment.” ....
