A traditionally republican strong hold that nbc news now calls a tossup a federal judge today rejected a republican push to throw out 127,000 ballots in Harris County, including houston, ballots that were dropped off at a drivethrough voting place Harris County is a strong hold for democrats and has the most residents of any county in the state. A group of gop candidates and an activist argued that drivethrough voting stations violate the u. S. Constitution. A judge ruled against them saying they didnt have standing to sue in short, the votes will count nbcs garrett hake is following the case in houston now. Garrett . Reporter hey, shep two wins in two days for Harris County and for the 127,000 voters who cast their ballots through drive throughs a federal judge agreeing with the texas Supreme Court which dismissed in the same lawsuit at the state level over the weekend. This means that those 127,000 ballots will count and the judge did say that if youre going to vote in Harris County tomorrow, he urged people to vote the oldfashioned way, to not use the drivethroughs, but those ten drivethrough locations set up by the county clerk as a pandemic safety precaution will still be available and operational tomorrow should they see fit. This is a state that came down to 250,000 votes or so in total in the senate race two years ago. Every one of those 127,000 votes could count. Shep, this isnt necessarily over yet the plaintiffs in this case, republican lawmakers and activists, have indicated they plan to file an appeal moving this up the chain in federal courts although its hard to see how another federal court would decide to potentially throw out the courts after a lower court and the texas Supreme Court said they should stand, were in the middle of aen election. The Postal Service feeling the pressure ordered to take extraordinary measures to return ballots on time and there are a lot of them out there. Almost 32 million have not been listed as returned that according to the u. S. Elections project as of sunday time is really running out 28 states do not accept mailin ballots that arrive after election day that includes battle grounds, florida, georgia, wisconsin, michigan, arizona. How are they dealing with this reporter federal judge Emmitt Sullivan ordered them to reiterate in writing the extraordinary measures thats if taking requiring them to use the Fastest Network available to process ballots, to establish separate retail and drivethrough lines for ballot postmarks and to collect and process ballots outside of normal business hours, that includes early processing in the morning and late handoffs with boards of elections. The order comes after the Postal Service said that on time ballot delivery was slowing just days before the election. On wednesday the Postal Service had a processing score of 97 for delivering ballots but by saturday that had deteriorated daily to 91 and was worse in some swing states. What our country has always been is a country that says we have the best system on earth, which is a democracy we have free elections that other countries should emulate if we had an election that seemed to be flawed or in some ways corrupt that allamericans cant get behind, thats going to be very hard for us to say that were the last best hope of human kind as jefferson said the president could have tried to expand his base, as most president s do after they won an election.
