federal offenses. even if the president wanted to pardon manafort, that would only work for federal crimes. state crimes cannot be pardoned. it would go forward and not be barred by double jeopardy because he was convicted in federal court. >> this was a 7-2 decision. what was the argument? >> it was a surprise to me there was any dissention. the reality is, we have long complained this whole double jeopardy protection is zero protection. there are so many exceptions to the rule. it doesn't feel right if you are charged with a state crime, in this case, felony in possession of a firearm and the federal government comes along and says, that sounds like our crime.
