Maria yeah, i mean, youve written police are in difficult situation and lack of leadership and you dont really have you dont see the support from the governor and the mayor from the police and support from what we have seen with these strategies. How are police going to get this right . This is a difficult thing. You impose a curfew, hey, theres a curfew, you need to go home and the person says im not going home, at that point you do you forcibly do you put hands on them. The minute you put hands on another human being its going to escalate. If i put hands on the other human being this could escalate and later on will i be criticized for doing this. This was a peaceful person and they dont want to leave and this is where it gets confusing. You want me to enforce curfew, what am i allowed to do, if i do that will you support those actions . Why were the stores filled with millions and millions of merchandise since they have been shut down since midmarch, some people got smart, the tesla cars they werent out on display, why was a rolex store filled with millions of dollars of rolexs, why were the luxury goods retailers filled with merchandise waiting to be stolen because these stores have not been open since midmarch. They do not complete, Martin Luther king, jr. Said no violence and with this lawlessness, the way its confronted you must have order. President trump understands that. He made a very clear message when he walked across the lawns without harming anybody, that did not happen and as he stood in front of the church, very strongly he was reminding us that theres prayer in the white house, that he believes in god we trust, he believes in a nation, one nation under god. With that type of i live in atlanta, georgia, our mayor was saying that the National Guard has been engaged. King, what advice do you have then for the protestors . I believe that the protestors have to be peaceful. I was a demonstrator, protestor in the 1960s, youth organizer and in the open housing, Fair Housing Movement and we were instructed and taught to demonstrate peacefully, to march together, sometimes we were saying we had a purpose, we marched to city hall, young people in forefront who protested there. We did even lay down in chambers. I remember we did that but we did not resist and we did not fight back and no struggling and no fighting. Maria Dagen Mcdowell. Dagen alveda, what would bring more people back into the church . Do you think thats something that will ultimately remind us that theres a higher power and also bring us together as a country . We had a fascinating, phenomenal experience with the church during covid19 and the shutdown, the church never shut down, it never shut down in that the church is not a building and walls only. You can go in the building and sit in four walls and participate and act together but we the people are the church and so the church is actually grown during covid19. Insane. Maria so sad. I saw some of those pictures yesterday. It really was devastating to see all of those stores, all boarded up and what is taking place in new york city this week. Among the top stories that we are watching this morning, tensions are still running high across america as protests go on for an eighth straight day over the willing of george floyd. Peaceful testimon demonstratorsg violence and t looting yesterday. Some protesters defied orders. In new york city, protesters got stuck on the Manhattan Bridge. They blocked both sides for more than an hour, stretching past the citys 8 00 p. M. Curfew. 28 states and washington d. C. Activated the National Guard at this point. In washington, d. C. , mostly Peaceful Demonstrations heated up yesterday, just after midnight, when protesters attempted to tear down the 8foot fence at Lafayette Park near the white house. Police using pepper spray to control the crowd. This after the mainstream officers wrongly reported officers used tear gas on protesters monday before the president s walk to saint johns church. They used a form of pepper spray that may produce similar symptoms. Nearly 3,000 police most arrests happening in los angeles county. The suspects charged with looting, burglary and vandalism according to the la times. Los Angeles Police also arresting a man for allegedly imperson ating a National Guard soldier. He was taken into custody overnight along with a supply of weapons after he allegedly tried to join a unit protecting downtown la from looters. Protesters again taking to the streets of new york city last night, ignoring curfews and roadblocks put in place to protect the city. Kristina is in manhattan this morning. Reporter several protesters stayed out past the curfew. Here on madison avenue, were seeing barely any damage. Take a look at some of the stores behind me, theyre boarded up, including beleciaga. I want to point out how high the wooden planks have to go. What happens with looters, theyll rip it down. Everything seems to be 10 feet or more. Not everybody is putting up store. This store, look at the insight. They completely gutted the whole store, retailers and businesses arent taking any chances. We also have footage from just across the city, so its like were in a hurricane, preparing for a hurricane, given that absolutely almost every storefront is boarded up. Youve seen unfortunately looters rip through those plywoods, often theres glass that needs to be swept up in the morning. This is the scene across the city. Several people tried to block protesters or looters from entering a foot locker and a gap yesterday evening. Mayor de blasio tweeted that at 11 00 p. M. , saying the curfew seems to be working because theres less damage this morning or less damage at that point. If you take a look too, we have footage of apple, the iconic apple store on fifth avenue near central park, normally a big glass cube. Instead, they boarded it up with wood. Also, there are guards over there. But overall, maria, i spoke to two Police Officers that did want to point out that the looters and thieves are tacking themselves onto the protesters. Theyll take their cars, theyll take scooters, target stores and switch and move to another location. So its causing the Police Officers in the city to constantly zip around throughout the evening to the various targeted locations. At this point, the entire city is boarded up. Its like we had a hurricane come through here. I dont know what else they could possibly hit. It seems a little better this morning. Back to you. Maria yeah. And it was hard enough as a result of the shutdown, this will obviously only elongate the trouble that new york city and our Retail Sector is facing across the country. Kristina, thank you. Maria we did see significantly less violent as you just heard, protesters took to the streets petitionfuly last night with peacefully last night with fewer police confrontations. Give us your assessment of where the situation is today. Any men who saw the video any american who saw the video of George Floyds death was sickened by as i was. Peopl. Pampeople have every righo protest, provided the protests are peaceful. What weve had over the last few days is opportunistic thugs who decided this was a chance to loot and riot and engage in mayhem. Too many elected officials in cities and governors around the country decided that maybe they needed a little bit of room and in fact what you need to do is nip that kind of violence in the bud. Finally, it looks like more resources are being put to work, more of the manpower that we have is being deployed. And hopefully weve turned the corner on this violence. Its completely unacceptable and cannot be tolerated. Maria what can the government do . What can this administration do to calm things down . Youve been critical of the president s reaction to these demonstrations. Early this week you suggested that the president , quote, change the tone of his message. What do you mean . My message was about how important it is that we have zero tolerance for this violence, that we deploy the manpower that we need. My message is that this is it is simply not true that our Police Forces are systemically racist that most police are somehow the problem. The fact is the police are the solution. My message is theyve got to be used and used properly so we can restore law and order. That is governments first obligation. So i think some of the president s tweets could have been different. Im not his tweet editor. Thats not the point. Thats not the problem here. The problem here are these bandits, criminals, who have seized an opportunity to wreak havoc. That cant be tolerated. Maria this is only going to elongate a recovery that would we like to see for Small Business and overall americans who are out of work. President trump is looking to press forward on negotiations go ahead, sir. Yeah, no, its so important that we get back to work. Many places including my state of pennsylvania has been way too shut down for too long. Its overdue. This is a terrible setback for so many people. Its worse than that. We know from having gone through similar experiences in the past, when the police come under attack like this, theres the ferguson effect. When the police are being attacked on the streets and second guessed by political figures, the danger is that they withdraw to some degree and then murder rates and crime rates in those very neighborhoods go through the roof and so thats the real danger here, as well as the economic danger. And this is why you cannot tolerate violence. Maria yeah. Which is why theres criticism for not supporting our troops, not supporting our Law Enforcement. I mean, you know, if the police do not expect that the governor and the mayor are going to have their back if somebody throws water on their heads, then theyre not going to come out. Theyre not going to be as aggressive as you would expect. And when youre talking about an economy that continues to look like its tough out there, that also creates more crime. I mean, the president is trying to press forward on negotiations for the next round of the Coronavirus Relief. As early as this week, democrats, some democrats and republicans are still clashing over what should be included in the next package. Where do you stand on this . What are you looking for in terms of what should be in the next relief package . Im not at all sure that we need another relief package, maria. Look at what we have already done. Between the direct spending that we have approved that weve authorized and the lending from the fed that weve authorized to complement that, that will total something on the order of 6 trillion. Like 30 of the entire annual economic output of the United States. And maria, far less than half of it is even out the door yet. Why would we be talking about going back and either printing more money or borrowing more money, because those are the only two options, when most of the money weve already authorized hasnt even gone out the door and our economy is beginning to reopen. Im not at all convinced that we certainly dont need another piece of legislation now. Im not convinced that we will. I think we should wait. Lets see. Maybe a month from now well see that there are some serious needs that still are unmet but, boy, weve done an awful lot. Weve replaced the vast majority of lost income for people, for low income workers weve actually more than replaced their lost income. Demand is going to be there. Its a matter of being able to open up safely. I think business can do that. Obviously, this whole series of riots has been extremely unhelpful in this regard at many levels. But its not clear to me that we need yet another round of hundreds of billions of dollars when so much hasnt even been spent yet from previous rounds. Maria by the way, while so many are actually making more money right now being home than they would be on the job, the idea to give them more money to stay home, why would they come back . You want the economy open in the next couple weeks, that program is in place until the end of july. So why would they actually come back if theyre making more to be home. Real quick, senator. Weve got to jump. It was shocking when our democrats insisted that people should get paid more not to work than they get paid to work. Its a bad idea. Its time to reopen this economy. Check this out, futures pointing to a rally at the start of trading, a gain of almost 200 points on the dow this morning, up 173, nasdaq futures up 33, s p futures up 14. Weve got optimism over businesses across the country reopening and progress being made toward a coronavirus treatment eventually a vaccine. This morning we expect the private Sector Employment estimate from adp ahead of of the friday jobs report. We are expecting 9 million jobs lost last month. That even though it is a sharp number, an i improvement from e more than 20 million jobs lost in the month of april. Joining us is Citi Private Bank investment officer, david bailen. Before i ask how youre allocating capital, can you give us your sense of the backdrop as we await the a dp and as we know 40 Million People have already filed for Unemployment Benefits in the last nine weeks. Well, this is an unusual time. This has been a shutdown of the economy like almost an engineered National Strike in order to keep everybody safe so its very different than a normal recession and the recovery will be as well. We expect about half the people who lost their jobs during this Second Quarter will actually been reemployed in the Third Quarter and there will be a slow recovery after that. Part of that is due to the fact that the government took proactive action to actually support the economy with the fiscal measures you were talking about as well as with the monetary support. So we see a vshaped recovery taking shape and we see a lot of people going back to work and as a result of that, what weve done is were rotating our clientss portfolios to small and midcap stocks which performed less well than the large cap. And we think that rotation will be very good for clients. Our outlook shows there are certain brazil and mexico are deeply undervalued. Maria so you still like brazil and mexico and some of the emerging markets out there along with small and midcaps in the u. S. Then . Thats correct. We want our clients to really diversify the areas of the market which have not come back as much. If you think that the u. S. Is going to come back, then certainly mexico, which is a major supplier and manufacturer for us, as well as the sort of commodity areas of brazil will come back. These markets have been down about 50 in dollar terms. If you look at 2009, they came back extraordinarily strongly. So what were doing is positioning our clients for the next 12 to 18 months, not nor the news thats happening today. And theres quite a bit of money to be made in the markets by doing that. Maria well, i wonder what you think then of Chinese Companies that are currently listed on the u. S. Exchanges. Weve been covering this for a while now and weve been going and walking through various bills in congress, senator kennedy has a bill that basically says, look, if Chinese Companies are listed in the u. S. , they have to follow u. S. Accounting rules and if they dont, we should yank them off the exchanges. That bill passed the senate. We are waiting to see if it goes to the president s desk and the president signs it into law. Even the former National EconomicCouncil Director and Goldman Sachs president gary cohn on the program last week weighed on Chinese Companies trading on u. S. Exchanges. Watch this. Got to get your take. I know the China Business was a big business for all the Financial Services companies but these guys dont even follow the rules of accounting standards in the United States, gary. Shouldnt they be following the rules that every other company does if you want to be listed in new york . We have our gaap accounting standards in new york. Yes, we should have any Company Listed in the United States follow our prescribed standards. Maria what do you think about that, david . Gary said he would not advise looking to go public to list in hong kong, now with the protesting going on there and the overreach from china. Having the accounting standards makes sense. Thats part of the rules of listing for stock on the exchange. We have to remember there are several different groups of chinese stocks specifically and the larger of them do follow many of the accounting standards, the international gaap accounting standards that gary cohn was talking about. The idea of Higher Standards i think is an important and good one. But we also have to remember that we want to have all of the international stocks, the highest quality stocks listed in the United States, listed in london, listed in asia. We want to have a market that operates globally because thats good for investors and thats good for our clients. Maria yeah. You definitely want to see diversity. Real quick, david, on this. Do you think if that does go into law, the president signs it into law, that those Chinese Companies have got to follow u. S. Accounting standards or they get yanked from the index, do indexes like the global indexes, do you think they decline in value given the fact that those Chinese Companies have such big representation on some of those etfs and indexes. In the event they were to be eliminated from the indices, then of course it would definitely have a very large impact depending on how those companies actually performed. What we really want to have happen is better accounting standards for all Companies Globally so investors have transparency and so if we onthe business realm, what way want to do is encourage is the following of the standards. That should be the nonpolitical reason to do this. We want u. S. Investors to have access to asia which is one of our dominant trends for the next 10 years, we want more clients, more money there. Thats going to be good for american investors to do that. So having better standards i think is a very wise idea and giving ample time for having people meet those standards makes complete sense to us. Maria david thank you so much for being here. Maria welcome back. Investigating the death of george floyd, minnesotas state department of human rights taking a closer look at the Minneapolis Police department. Governor tim walz says the probe will focus on evidence of racism in the department. Joining us right now, judge andrew napolitano. Judge, what do you think . I think its too little too late. I mean, this is not a lawsuit against the Minneapolis Police department. This is an internal investigation by the bureau of human rights of the state of minnesota against the Minneapolis Police department. This is probably basically a pr venture on the part of the governor. Something like this should have been done a long time ac ago, lg before george floyd was killed. Nevertheless, its a step in the right direction. Theyre probably going to discover a lot of other issues in the department about which we dont know and maybe remedy them before theres another catastrophe. Minneapolis Police Department maria didnt the guy have 17 infractions. They dont have the training that new york, los angeles or chicago has, wellknown in the community. Maria one of the officers that kneeled on George Floyded neck, didnt he have like 17 infractions . Yes, he did. The other three officers im waiting for them to be charged. They should be charged with aiding and abetting. First of all, he should be charged with first degree murder. During the eight minutes the knee was on of floyds neck he obviously planned and plotted to do the continuing. They should be charged with failing to stop the murder. By failing to stop, they aided and abetted it. They havent been charged with anything. Maria i want to switch gears, ask about bail reform. The more than 400 people arrested for looting in new york city will most likely be freed after receiving a burglary charge. The new laws prohibit bail for felony burglary charges. Weve been railing about the new bail Reform Program for two years where no bail means they process them and the criminals back on the street and what do they do, they go and they commit more crimes, making our cities unsafe. Well, this is yeah. Youre right. This is a chickens coming home to roost. This was the brainchild of Governor Cuomo who now of course wants to address this by putting the military in the streets. He can put the military in the streets and they can arrest people and they can appear before judges and theyll be back on the streets. In new york, it doesnt matter what the evidence is against you because the law ties the hands of judges. Dagen and i have been screaming about this and you have as well, since this law became law. It is just an attack on the property of individuals by allowing this revolving door of people who should be in jail to get arrested, appear before a judge, back out on the streets. By the way, all this happens in 36 hours. Maria yeah. Well, you know, when i spoke with andrew cuomo about a month ago, he said im going to look at this and have a change in this by april 1st. That came and went i guess because of the pandemic. But we havent seen any changes. Judge, well keep watching that. Go ahead, final word. Go ahead, sir. You know, its not his fault that the legislature is not meeting. It is his fault that this misguided legislation existing for two years. Maria all right, cheryl, thank you. Well, unrest in the empire state continues, new york city seeing largely peaceful protests yesterday, crowds marching to manhattans upper east side. Mayor bill de blasio lives. More reports of looting as night fell, protesters defied the 8 0. Governor andrew cuomo spoke out yesterday, blasting mayor de blasio for not doing this job. The nypd and the mayor did not do their job last night. I believe that. Look at i the videos. It was a disgrace. I believe the mayor underestimates the scope of the problem. I think he underestimates the duration of the problem. My option is to displace the mayor of new york city and bring in the National Guard, do your job. Do what youve done in the past. You know how you stopped looting in the past and how you stopped rioting in the past . Do that again. Maria joining me right now in a fox business exclusive interview is the former governor of new york, and Las Vegas SandsSenior Vice President , David Patterson. Governor, great to see you this morning. Thanks so much for joining me. It is great to have your insights. What do you think about that in terms of Governor Cuomo being able to replace mayor de blasio . Can he do that . Maria, under article 4, section 2 of the new york state constitution, the broad supervisory powers that the governor possesses would allow him to supersede the authority of a local elected official through executive law 63, section 2. So he could do that. The use for this has been common by governors, often when they replaced a District Attorney with a special prosecutor because they thought an investigation had been tainted. Here, you would have to show corruption, youd have to show wrongdoing or you would have to show a reckless disregard for human safety which is i think where the governor would try to go in this case. But he said that the mayor underestimated the problems with the rioting. I think it would have to rise to a level where he knew that he was doing it and recklessly disregarded the public. Maria so what do you think is reckless . Lets show some of these pictures of new york right here, whether its downtown in soho, where storefronts were cracked, windows cracked and broken into or madison Avenue Uptown where some of the big, high end stores like belenciaga and chanel, efforts to breach there. What is reckless . This went on for hours, governor. What would you have done . Well, you see, a Strong Police presence before the riots ever get started usually quells this kind of disturbance. But were dealing with a different type of riot than we were years ago. Years ago it was people from the community who were outraged by a shooting, a hate crime, a Police Involved shooting. What we have now is clearly outside agitators who actually bring the bricks in that are being thrown at people and who actually are waiting in the crowd, waiting until it gets late when people are more vulnerable and then starting situations and unfortunately frustrated people follow them. So in this particular case, you know, i think a lot of elected officials on both sides of the aisle have made mistakes in dealing with these types of situations, underestimating how bad it would actually get. But i think you would have to have a showing that the elected official didnt care, like im doing it my way and i dont care what the facts say or what the pictures show. Maria well, i mean, the pictures are clear and youve heard the violence. I mean, would you have brought in the National Guard at this point . You know, hes pushing back to bring in the National Guard. The mayor is. Well, i think that i think that the governor in this particular case can actually execute that without even having to take any action against the mayor. He is the governor of the state. Hes the commander in chief of the Law Enforcement around the state and has significant influence over the National Guard. If he so chooses. Hes trying to let the mayor make that decision. There are a lot of factors that go into making that decision that i dont know. So i couldnt tell you that i would know what to do in this situation. One problem that no one has raised, because this would be a terrible time a terrible time for a terrorist attack. If there was any evidence of Something Like that, i would bring in anyone i could to stop it. Maria well, its a great point. Well, yesterday i spoke with new york city former new york city mayor rieu city giuliani and i asked him for his take of what was going on in the city. Listen to him. I want to get your reaction. The mayor should step down. Hes incompetent. We are moving we are losing a tremendous amount of property. Were seeing people damaged and hurt seriously. Pretty soon were going to lose some lives if this man doesnt get out of the way and let someone activate the Police Department. Maria how do you know that hes holding back the Police Department . Youre right, all of that looting and destruction last night should have been stopped sooner. Hes following all these liberal progressive mayors are following a playbook thats about 35 years old and totally discredited. Its called the venting theory. They let them sort of like get it out of their system for a day or two and then the city blows. You dont have to tell the Police Department to do the job. All he has to do is step aside, these will be over in one night. Maria what do you think about that, governor . And by the way, you know, were talking a lot about new york city. Its not just new york city. An officer was rammed into in buffalo. Its all over the state. Your reaction . Maria, next time you see the mayor, tell him that i thought he made a good point for a change. Hell be shocked to hear that. The reality is that exactly what i just said. This is a different type of group thats causing these riots now. Most people really dont want to see any violence at this time time because you practically have a pry m you dont need y distrackdistraction from that. Weve been distracted for a period of time now and honestly anything that would keep the peace in cities around this country could get us to focus back on a bigger problem, which is that the peaceful protests are trying to point out problems that exist in the Police Department as they exist with elected o officials. They have trouble weeding out the bad eggs. If we could get past that in both areas our country would be in a lot better place than it is now. Maria i think you make a really important point. How do you weed out the bad eggs . How do you know where the racism is in the Police Department . This has got to stop. This is on top of more than 400 people awaiting arraignment in Manhattan Criminal Court yesterday afternoon for allegedly Looting Stores the night before because of new york states bail reform law passed earlier this year. Most will likely be cut loose without bail. David, look at the state you love so much. Look at the city we all love so much. Weve got bail reform that has criminals back on the street in a couple of hours and theyre committing more crimes. Weve got people fleeing new york because the tax situation, homeless situation getting worse and on top of all of that weve got a pandemic, a shutdown and now looting as a result of the death of george floyd. How are we going to get out of this . How long is it going to take for new york to get strong again, in your view . Wellsaid, maria. Were looking for a new mayor in 2001. You might want to consider that. The point is, the bail reform needed to happen but the way it was happened was excessive. It allowed too many people out of jail. This is a situation where one person was released on bail at 12 00 and committed another crime at 4 00. We cant have that kind of thing going on. I think most people in new york city know that. There were problems with the previous bail system that we tried to address. But i think the important thing is that this should be a hint to all of us that there have been a number of these policeinvolved shootings where there were no protests and people waited patiently for the system to do something and the system is not. Thats why youre feeling a lot of the outrage. There is no excuse for violence, looting, attacking the police or some of the things weve seen in the past week and you do have to take stringent forces to stop that. Maria all right.
