Eastern time some good news to show you, nice gains there, the nasdaq is in record territory as the dow is looking to crack 30,000 once more today after the index crossed the milestone earlier in the week. Ruling on religious restrictions, the Supreme Court telling new York Governor Andrew Cuomo he cant put a capacity limit on houses of worship. Were on this story today. Plus, it is black friday, its going to look a little bit different. Retailers going with the shift to online sales as brick and Mortar Stores are rethinking foot traffic this year. Asian markets overnight, you had green across the board in asia. The best performer there was the shanghai composite. And some of the top stories we are watching this morning of for you. President trump taking questions from reporters in his first extended public event since the election. He did say he would concede if he had to. But emphasizing the reports of massive Election Fraud are still on the table. If the Electoral College votes for joe biden, will you concede. Certainly i will. And you know that. But i think that there will be a lot of things happening between now and the 20 oft 20th of janua lot of things. Massive fraud has been found. It will be a hard thing to concede. Cheryl the president also announcing plans to visit georgia saturday, december 5th to campaign for the Republican Senate candidates, the Senate Balance of po power hinging on e runoff racess in that state, two races need to be decided. Covid19 cases on the rise, hospitalizations related to the pandemic reaching a new record high for the 16th straight day while more than 181,000 people tested positive on wednesday. On the same day that the tsa reported over 1 Million People were screened, making it the busiest travel day since march, despite cdc warnings for people to stay at home. Astrazeneca defending its covid19 reports amid reports of dosing errors in the clinical trial. The company says despite the errors, the data shows the vaccine is effective, though some question the accuracy of the 90 rate. The company says its rate is well above the 50 effectiveness mandate issued by the United States government. Taking a look at astrazeneca, the stock on the news and the questions about the trial, the stock is down more than 1 andahalf percent right now. President trump pardoned his former National Security advisor, general Michael Flynn, just in time for thanksgiving. This was after a long legal battle. Remember in 2017, flynn pleaded guilty to lying to the fbi about his contact with a russian official before trumps inauguration. He later withdrew the plea, saying the fbi set him up. The Justice Department agreed and moved to drop the case this year. It is a friday, its black friday. We have green numbers to show you, the dow up 57, the nasdaq up 43, s p up 5 and three quarters. The nasdaq, interesting story here, closed at a new high on wednesday but the dow slipped below 30,000 as the return of lockdowns will threaten the economic recovery. The s p retreating from record territory but it could be a new day for the dow. Lets bring in ken mahone, also joining the conversation all morning long, James Freeman and Strategic Wealth partners president and ceo, mark tepper. Gentlemen, good morning to all of you. Its great to have you here. We have green arrows to show our viewers. Ken, lets start with what were seeing as far as the markets go. Youve got three vaccines in western countries, astrazeneca, the pfizer, biontech and moderna vaccine. While the vaccines arent goings to be out to the general public for months, wall street seems to be ready to move ahead and move higher. The market is looking six to nine months out. Were looking at here and now, yeah, the numbers are ugly. The pandemic continues to spread throughout the country. Its like Wayne Gretzky say, its not where the puck is, its where the puck is going. Investors, where the puck is, its not a great spot to be right now. Where the puck is going, six to nine months from now, where hopefully most of this is diminished, thats where the market is looking at. The airlines, cruise lines, im not sure i want to chase those but at the same token the market is looking down the road that were going to have vaccination help and thats three of them that you mentioned, others are in trial, there are therapeutics, so help is on the way. Cheryl any hickups you see in the next three months that could upset that . Yes. Theres always hiccups. More and more states are shutting places down, here in new york city, shutting down schools. When you shut down schools, you shut down people who work, who have to go to work and so forth. So the shutdowns and unevenness, it makes things choppy. I think this black friday will show consumers, pretty good consumer sentiment, considering all the factors. Looks like well have a 20 increase of sales of black friday from this black friday to last, most of it will happen online. If you look at Consumer Spending, super impose that on stock markets for many years, the lines are pretty well. We expect good Consumer Spending next year. The pentup demand, get us out of our homes, go to italy, buy an rv, do these things we want to do, i do believe there will be pentup demand. Consumer spending i think will be strong in 2021 and that correlates to the stock market. Cheryl i want to bring mark tepper and james free intman ine conversation James Freeman into the conversation. Theyre forecasting an increase in spending of up to 5. 2 . That could bode well for the names weve been tracking all year long, including your amazons. James without a doubt. I think it will come out on the high end of the range. Look, if youre a grand parent, you cant see your grandkids over the holidays, are you really going to tighten the Purse Strings and not spend as much this Holiday Season. I think youre going to do the opposite. I think youll see an increase in spending. Were looking at already in october retail sales were up 10 year over year so i think that continues. I think its going to be a blockbuster Holiday Season. You mentioned amazon. Absolutely. Most of the shopping is still going to be done online, so ecommerce is the place to be. There are some old cool brick and mortar retailers that could do well in addition to amazon but amazons a big winner there. Cheryl i said amazons, plural, because its all of the retailers that are heavy into online shopping, and ill put walmart and target into that because theyve boosted Digital Sales stories over the last few months. James, one of the things the market is looking and waiting for is stimulus. Where are we right now . James well, i hope theres a realization in washington that stimulus we need is continued reopening. I hope the vaccine gives people some comfort that multiple vaccines that were seeing light at the end of the tunnel here. I think more reopening i think as weve been describing, i think this economy is ready to roll. One thing i was wondering, as you look further out, do you see inflation with a Jerome Powell fed and janet yellen at treasury, do you see inflation eventually on the horizon and how does that change your investment thesis. Now, just to be clear here, december 14th the electorals do cast their ballots. December 14th. How does the president navigate these next two weeks . Well, hes going to continue the legal fight, obviously. The president continues to assert that this election was stolen. I think hes saying weve got evidence e wer, were going toe evidence, its just taking too much time. President trump is setting up the idea that hes going to run for election again in 2024 and hes going to be arguing that hes going to be waving the bloody shirt for four years and saying look, the election was stolen from me, i was the rightful winner of this election and you need to right this wrong and for the people that voted for me but in the meantime hes going to have to croon seed and leave the concede and leave the white house, and thats going to be tough for him to do, considering he believes he won the election. Cheryl in general, the critics of the president would say that hes eroding democracy by casting doubts on the election. Still, you know, moving forward we are going to have another election in january and the person on the line right now seems to be Mitch Mcconnell. Yeah, look, i think some of this stuff about where eroding democracy, this is an existential threat to our democracy is overblown. He has already started the train sismtion he doesnt have to consistent the transition. He doesnt have to concede. He will have to leave the white house. He said he will do that stacy abram hasnt conceded the georgia governors race. Hillary clinton continues to believe the 2016 election was stolen from her. Our democracy is going to continue to function. There is a transition underway right now, there will be a change, a peaceful transfer of power on january 20th. Donald trump doesnt have to concede anything. He can continue to believe and to the extent he can marshall evidence to prove the case that this election was stolen from him by fraud, hes welcome to do that and then the American People get to make their judgment. Cheryl Hillary Clinton did come out the day after the election in 2016 and did address supporters. It took several hours to get there. Lets gerald ford. Gerri lets go to whats happening in georgia. The president did say yesterday he will go to georgia on december 5th, a saturday. Hell campaign for david perdue and Kelly Loa Loeffler amid the Senate Runoffs that will determine the balance of power. Your thoughts on this . At this point, this affects everything. This affects stimulus, this affects Climate Change, this affects how we relate to foreign powers. If we have a blue president , we have a blue senate and a blue house, that could be very disconcerting not just for markets, but for the direction of the country. Yeah. And so heres the problem, right. Donald trump is going to go down there and, look, republicans are arguing, look, everything is on the line for all the reasons you just mentioned. The problem is and why republicans are concerned is that donald trump continues to say, look, even in georgia the election was stolen from me. Theres argument that the election that took place on november 5th was bogus. David perdue and Kelly Loeffler are arguing it was stolen. Why would voters in georgia, especially those who turned out to vote for President Trump more so than anything turn around and go back to the polls on january 5th and vote just not for trump but for david perdue and Kelly Loeffler if theyre being told and they believe that that election was fraudulent and that it was stolen from them. Those are the competing interests. Certainly republicans are trying to hopeing theyre able to energize their base. Democrats have the same problem, by the way, folks who just turned out to vote against donald trump, they didnt turn out to vote so much for joe biden as they did to turn out against him, remove him from office. Democrats achieved that objective. Why would they go back to the polls on january 5th. Both sides are trying to energize their bases. There are competing interests there. Cheryl i will say, both perdue and loeffler asked for the secretary of state to resign in georgia, a republican, i want to be clear. It will be interesting to see how they maneuvered the weeks since the election, will affect how theyre perceived and i think turnout will be interesting. Cheryl the cost of college, congresswoman alexandria ocasiocortez taking to instagram, saying that joe biden can and should bypass all student debt by executive order, meaning bypass congress. Senator Elizabeth Warren commenting that biden could use his existing authority under the Higher Education act to order the department of education to cancel Student Loan Debt which by the way is clearly sitting at about 1. 7 trillion. James, this is what i think is interesting about all of this is that its not even december yet and shes already pushing for more progressive action and is trying to push Mitch Mcconnell to side on all of this. James i think taxpayers hae to be infuriated if theyve been watching the drama over the last several years, politicians like senator Elizabeth Warren who when they were add v advocatinge big expansion of the program kept telling us it would be a big winner for taxpayers. Now the government is looking at 400 billion in losses on their portfolio and as you said, now the suggestion is lets turn all these loans into grants, essentially. I dont think its happening. I hope not. The president would need to go to congress to do this. There are various options the government gives people to get some he relief on their loans but there is not an ability for the white house to simply decide that these loans dont exist anymore. Cheryl right. I mean, look, mark, whats interesting about this is that 1. 7 trillion number, that is the largest amount of nonmortgage debt in this country. And one in six American Adults have Student Loan Debt right you now. So its not that it isnt a drag on the economy but how you deal with it is still has not been dealt with and is still that question mark. Mark yeah. Look, when were talking about this whole student loan cancellation scenario, if these Student Loans are canceled i believe its going to anger a heck of a lot more people thane its going to make happy. Anyone that has paid off their loans is going to be upset. What about the person who decided to forego maybe attending a tier one college to save money, the cab driver who didnt go to school, now he has to pay off someone elses debt and that person may make more money than hes making. It doesnt make sense to incentivize an individual to rack up a bunch of debt for a degree thats not productive in our current economy and none of this discussion really solves the real problem which is egregious tuition rates. Thats what needs to be dealt with. Cheryl i was about to bring that up with you, because i find it egregious that colleges across the country are saying were going to send you the exact same a amount of money to send your kids to school but theyll be living in your house and doing Remote Learning and not have the college experience. A lot of college kids are not going back to school until january. James its really shocking or maybe not so shocking when you look at the democratic coalition, how that issue of the root cause never seems to come up in these political discussions about how big the subsidy is going to be into Higher Education. That question of why are we subsidizing it . If we didnt have all of these generous programs, wouldnt there be market pressure downward on tuition . Wouldnt colleges have to justify the expense in a way they havent to this point with all of these methods to get the federal government to pay for it. So and i also i agree, fundamental unfairness of asking someone, especially who didnt go to college, a worker and a saver, to now subsidize and forgive the debt for people who in many cases are not poor. Cheryl how is that fair . I paid for my college. I didnt take out one loan. I paid for it. But now im going to pay for somebody elses . Youre right. I get it. Its a great point. Lets take a look at where your markets are at 6 30 a. M. Eastern time. Taking a look at futures right now after markets were closed for the thanksgiving holiday. Dow up 54, nasdaq up 44 and three quarters, s p up 5 and three quarters in the premarket. Wall street is going to have a half day of trading today, markets close at 1 00 p. M. Eastern time. As a for european markets, we can see pressure on the ftse, brexit is a big story there. As you can see, a little bit of pressure on the london market in france and germany, youve got green arrows. Asia, lets take a look at a those markets can, green across the board, shanghai composite up more than 1 . Some of the top stories were watching for you this morning. A u. S. Navy veteran and Data Scientist is claiming 47 usb cards used during pennsylvanias election are missing and says as many as 120,000 votes should be called into question. During a hearing, organized by the pennsylvania gop earlier this week, the Delaware County poll watcher alleged the cards may have been used to add illegal votes and claims there was a lack of proper oversight on how state election workers handled the ballots. Disney announcing another round of layoffs amid the pandemic. The company says roughly 32,000 employees will be impacted, about 4,000 more than its last round in september. A majority of the layoffs will come from its theme park division. Some locations, like disneyland, still remain closed while other parks have seen operations at limited capacity. Lets take a look at the stock in the premarket, its one to watch for the dow today certainly. It is just slightly, slightly down in the premarket. Well, private equity firm Sycamore Partners agreed to buy ann taylor and other groups for 14 billion. It still needs approval from bankruptcy court. Amazon workers in germany choosing to strike on black friday. The workers at seven warehouses are calling for higher wages and better working conditions including better coronavirus protection measures. The same union previously chose to strike on amazons prime day earlier this year. Stock is up more than three quarters of a percent in the premarket. Soccer legend Diego Maradona has been laid to rest. Huge crowds turned out at his hometown yesterday to pay respects. Good morning to both of. Ted, your reaction to the president s comments yesterday . I think they were legitimate questions. I think the better question is will joe biden concede if the Electoral College does not give him the 270 votes that he needs to be president of the United States. I think thats after listening to the legislative hearing on saturday, i think thats much more likely a situation thats going to happen than the fact that joe biden will get the 270 votes necessary. Cheryl based on what, though . Based on what evidence . If you listen to that testimony on saturday, they sent out 1. 8 million ballots to voters but they counted 2. 5 million votes. Thats a pretty significant discrepancy. Thats something that needs to be looked into. And then if you look at the spikes that were coming in in bulk batches of votes that were being counted, almost 600,000 of them went for joe biden but only 3,200 of them went for trump. Theres some serious issues that need to be looked into. Cheryl that may not be resolved yet. Im sorry. Cheryl i want to be clear, the certifications have been happening in states, the last day for states to resolve any disputes i is december 8th. If anything needs to go to court, it needs to go down and there needs to be evidence and we havent seen that, to be sure. It will be interesting to see if theyre able to prove their case. Cheryl laura, over to you. There is still questions about voting irregularities. At the same time, joe biden is in the transition, hes got the funds he needs from the government. But one question for you is, theres this big push from progressives like aoc and Bernie Sanders, theyre saying joe biden needs to do their bidding for them. Your reaction to how progressive do the progressive voices have much weight do you think with president elect joe biden . Well, theyre members of congress and they are entitled to voice their picks for but i think thats where you look. You look at what is joe biden doing. You look at names like janet yellen which i think there was a little stock market bump at the its not confirmed that shell be but likely to be announced next week as the head of the treasury department. You look at the National Security team, seasoned Public Servants from Anthony Blinken at state to linda thomas greenfield as the un ambassador. These are pictures that have been undersecretaries in the departments where theyre looking to serve, decades of experience. These are really stabilizing picks. Looking to really be centrists. So i think hes listening to progressive voices. So far we havent seen it in his picks. Thats the type of leadership that joe biden promised on the campaign trail and its the type of leadership hes delivering. Cheryl some of the critics are saying the president elect is appointing a lot of obama era administration, whether its National Security or cabinet picks that we know of confirmed so far and this is going to affect our foreign policy. You bet. And hes also looking at Hillary Clinton as secretary of defense. If they come forward with those kind of retreads of what happened during the Obama Administration, were going to have the exact same policies where we were stuck in a quagmire in iraq and afghanistan and we entered into a war essentially in syria. Weve got to have a serious conversation in america as what is our role going to be. Are we going to continue to intervene in foreign governments or and nation building, or are we going to focus on what is in the best interest of americas National Security. My brother worked in the Foreign Service his entire career. Thats a question even the professionals in the Civil Service want to have answered. Cheryl hopefully president elect joe biden will continue to put the pressure on china and we shall see. Lets move to georgia. This is really what is going to affect the balance of pow of wear in the country in the new year, the runoffs are heating up. President trump announced he will go down to the peach state saturday, the fifth of december, will campaign for the two incumbent republican senators. Estimated 192 million is going to be spent on advertising through the coming week and the january 5th runoff date. If you add that to whats been spent, were looking at about nearly 300 million, laura, that is being spent. At this point the democrats are spending more than the republicans. What is the crucial issue you see in georgia . Its all about turnout which sounds like a cliche but in a special election especially so. From is going down there to trump is going down there to stump for republicans. We know that the two republicans are going to have to hold the suburbs, something that donald trump lost significant ground in and so the democrats, the two Democratic Candidates are looking to pick up those suburban voters, particularly suburban white men. Looks like the white women are off the table. On the other of side, we have seen people like Deborah Scott and stacy abrams working since election day to continue to engage voters in communities of color, to register voters up until the deadline next week and focus on the young voters, some of them in rural parts of the state. So that Voter Engagement on the democratic side is going to be critical. Thats where a lot of the dollars are going to go, because the dems do need to outperform their usual turnout. You know, theres no secret that the dems are underdogs in the race but the stakes are really high and weve seen success in georgia. That surprised us before. Cheryl republicans need to keep one of the two seats and they will maintain the balance of power and i will say wall street seems to like it when we have a little bit of a check and a balance situation going on in washington. So i was looking at a Research Report from oracle research, oracle, they were saying that 48 of people will probably still shop online. So 48 of people still shopping online, 62 of people are expecting the same gift, if not more under the tree. So now that theres still sort of some states are having lockdowns, people are feeling weird about going into the stores. A lot of the shopping is going online. Cheryl mark tepper brought it up earlier. I dont know if hes with us right now. You said this, that people will spend more, theyre going to go online but theyre going to spend more money because theyre not with their family so the amazon guy is going to be the holiday delivery this year. Right. And i think mark right. Cheryl let me bring in mark to that. Mark, you did say that at the top of the show. Go ahead. Mark the only guarantee this Holiday Shopping season is the number of amazon packages on my front porch is going to accelerate, right. So i do think youre going to see more spending. I think for grandparents who havent seen their grandkids, throughout a brutal year where there havent been a lot of positives for anyone, i think youre going to see more gifts under the tree this year. I was just going to say its either parent guilt or people, to your point, people havent seen their families or i have not seen my mother in a year so im certainly going to go ahead and try to spend as much as i possibly can to make sure she feels loved and the rest of my family feels loved. President trump takes questions from reporters in his first extended public event since the election, saying he would concede if he had to but emphasizing the reports of massive Election Fraud still are on the table. If the Electoral College votes for joe biden, will you concede . Certainly, i will. And you know that. But i think that there will be a lot of things happening between now and the 20th of january, a lot of things. Massive fraud has been found. Its going to be a very hard thing to concede. Cheryl the president also announcing plans to visit georgia saturday, december 5th to campaign for the Republican Senate candidates. The Senate Balance of power hinging on those january 5th runoff races, two crucial races there. Covid19 cases still on the rise, hospitalizations related to the pandemic reaching a new record high for the 16th straight day while more than 181,000 people tested positive on wednesday. On the same day the tsa reporting over 1 Million People were screened, making it the busiest travel day since march, despite cdc warnings for people to stay home. Astrazeneca defending its covid19 vaccine amid reports of dosing errors in its clinical trial. Companies says despite the errors, the data shows the vaccine is effective, though some question the accuracy of the 90 rate. The company says that its rate is still well above the 50 effectiveness, the mandate issued by the United States government. Astrazeneca in the premarket, the stock is down more than one andahalf percent. Well, President Trump pardons his former National Security advisor, general Michael Flynn. Just in time for thanksgiving. This after a long legal battle. You might remember in 2017 flynn pleaded guilty to lying to the fbi about his contact with a russian official before trumps inauguration. He later withdrew the plea, saying the fbi set him up. The Justice Department agreed and they moved to drop the case earlier this year. And it is time for the word on wall street, top investors watching your money today. I think the vaccine news is where we need to go because investors obviously you have been cheering news of these three potential western based vaccines, if you will. There are questions about astrazeneca this morning. But overall these vaccines and how and when they get to the American Public will dictate how markets behave. Well, i think youre right. Right now, part of the optimism that the market is focused on is the prospect of a near term vaccine. Coupled with as we reminded earlier this week that the u. S. Economy is performing quite well with Third Quarter gdp surging, actually more than offsetting the decline that we saw in the second quarter, at least in percentage terms. Weve also seen strong gains in housing, manufacturing, auto sales. And as yo the biden administratn putting forth less controversial picks including chair yellen to run the treasury. Cheryl jp morgan is talking about potentially contraction in the First Quarter of 2021 when it comes to gdp. Were not there yet. But thats a possibility. Mark, lets pick up on this because we were talking with heatha earlier about retail. Black friday shoppers are turning to online sales, not going to the stores. We havent seen the video this morning. Nrf says theyre optimistic about the holiday and the numbers that well get spending in a range from 3. 6 to 5. 2 for the holidays. Is that enough to prepare the major retail companies, get them through what could be a rough q1 . I think it is. Now, lets keep in mind, cheryl, black friday which is typically the biggest shopping day of the year, but weve seen a lot of pullforward this year, right. October retail sales were up pretty significantly. People seem to just be shopping earlier and earlier, making black friday a little less relevant. The question is whether or not the consumer is going to spend. You mentioned that 5. 2 is kind of the top of the range. I think its going to be the biggest Holiday Shopping season ever, by a lot. I think were going to come in above that 5. 2 range. Because theres not much else to do other than spend money on gifts. Its been a rough year. People want to get through it and want to make up for it through Holiday Shopping. The thing to keep in mind is more and more Retail Shopping is being done online with ecommerce. I mean, ecommerce is up like 35 year over year, so from an investment standpoint in my opinion you want to stick with the retailers that have a strong online and mobile presence as well as a direct to consumer model. So the nikes and lieu lieu lemons of lul. Lemons of the world will do well. Amazon is the 800pound gorilla in ecommerce. Theyre going to do well. Im not crazy about the brick and mortar retailers like north strom, macys and kohls, theyve skyrocketed over the course of the last month. I think too much good news is priced in for some of those dinosaurs. Cheryl the dollar has been under pressure for a while but its hitting the lowest levels against the other currencies, this is a big story. Here is versus the u. K. Pound if you will. Investors keep betting that the dollar will keep going down. What does that mean . Look, theres some on the street that think the dollar will decline. Im not buying that. I think when you print 7 trillion out of thin air youll likely see weakness to your currency. However, because we took such bold aca shun our economy has action our economy has recovered faster and more significantly than other countries in the rest of the world. As some of these other economies come online and start to pick up steam as the u. S. Has, we will see weakening. I think a little bit of dollar weakening was a bullish sign for stocks. Its cheaper for overseas investors to buy our of stocks, easier for manufacturers to sell goods outside of our country. A little bit of weakness is a bullish sign. A lot of weakness could signal theres deterioration in the u. S. Or flight to capital elsewhere. Im not buying the latter part. I dont believe what some of the investment banks out there are saying that were heading for a 20 decline. I do think, though, that a little bit of weakness is a bullish sign and well probably see it as the rest of the world picks up steam the way the u. S. Has. And i didnt know i was lost cheryl President Trump announcing a full president ial pardon for his former National Security advice advisor, generl Michael Flynn. The president tweeted it is my honor to announce that general Michael Flynn has been granted a full pardon. Congratulations to general flynn and his wonderful family. I know you will have a fantastic thanksgiving. Joining me to discuss, a fox news contributor, byron york. Hey, there, byron. Good morning, thanks for having me. Cheryl democrats initially reacted, saying the pardon was undeserved and unprincipled for Michael Flynn. What do you say. First of all, its a pardon that makes a lot of republicans very happy because they think Michael Flynn was railroaded and theres a lot of evidence to support that. And so when you look at this pardon, its really in line with things that president s have done in the past. On Christmas Eve in 1992, president george h w. Bush pardoned Casper Weinberger who had been the secretary of defense who was charged in the iran contra case. He hadnt even gone to trial yet but bush pardoned him and put it into the whole thing. Plus, he pardoned several other people involved in the same investigation. When bill clinton left the white house in 2001, he pardoned henry sisnero, several people involved in the mike espe investigation and people who had been caught up in all of those independent Council Investigations during the clinton administration. In 2007, george w. Bush commuted the sentence of Scooter Libby who had been involved in what was called the cia leak affair. In 2018, donald trump pardoned him all together. So this Michael Flynn pardon is precisely in line with the kind of things that president s have done about investigations that targeted them. Cheryl i want to bring in James Freeman into this because your colleague, kimberly extras. Lstrasell says this is a requirement of justice. Thats what she wrote. James i agree with kim. The prosecution of general flynn was an outrage. We see that the government used this pretext of the logan act, this two century old law under which no one has ever been convicted because if the government ever tried to convict someone they would find it was an unconstitutional restriction on their free speech. They essentially investigated him for the alleged crime of talking as part of the transition with foreign officials, which is common, and disagreeing with the policies of then the Obama Administration that was soon to leave office. So i think this is very welcomed by lots of people who value our Constitutional Rights when they look at how general flynn was abused. Cheryl yeah. And you know, i think the other question here, byron, is who is next. What about Paul Manafort . What about roger stone . Byron, are you hearing anything about other people that President Trump is would like to or is set to pardon . Well, the president has already commuted roger stones sentence. Would not be really surprised about George Papadopoulos who pleaded guilty to lying to the fbi in a series of questions about russia. But really the lies were really quite minor and of course they were in pursuit of an investigation into collusion that never established that collusion ever took place. The manafort case might be a little stickier in the sense that manafort was never charged with anything involving a conspiracy or coordination between the Trump Campaign and russia. Robert mueller, the special counsel, never charged anybody with anything like that. Instead, manafort was charged in great part with evading taxes on millions of dollars in income, so not clear whether the president wants to go forward and pardon that. Cheryl i also want to move to another issue before i let you go, byron that were watching and thats the issue you of religious freedom. The Supreme Court ruled against Andrew Cuomos capacity rule for houses of worship as Amy Coney Barrett was a deciding vote on this. Pope francis spoke out against the restrictions, arguing theyre for the good of the people and he wrote its easy for some to take an idea, for example, personal freedom, and turn it into an ideology, a prizm through which they judge everything. What do you make of the back and forth between andrew cuomo, the Supreme Court and now pope francis has weighed in. The pope does not have a vote on the Supreme Court. This was an interesting case. I think judge gorsuch, Justice Gorsuchs position on this really spoke for the whole majority here, which is that andrew cuomo, the governor of new york, would leave open liquor stores, accu acupuncture, bicycle retea repair shops, whie imposing strong limits on religious gathering which is a protected activity under the first amendment. And Justice Gorsuch says we have this pandemic, it does require certain policies to deal with the pandemic but you cant ignore the constitution here. I think it was a really, really important measure and by the way would not have happened six months ago with a different Supreme Court. Cheryl yeah. James freeman, i want to bring you back into the conversation again because this was kind of this was big news coming out of the Supreme Court with this ruling and our first chance to see Amy Coney Barrett and her thinking as far as what her rulings are going to be moving forward. Your thoughts . James yeah, i think its a welcome return by the Supreme Court to standing up for Court Constitutional liberties this year. I think the pope maybe didnt realize whats been happening in the United States over these last six or eight months where again and again as byron suggested weve had state and local political directives that leave various activities in society open but put harsh restrictions on religious exercise. Weve seen it in various places. This case, important one, involving new york but youve seen it in jurisdictions all over the country and this is i would say hats off to President Trump for putting Amy Coney Barrett on the Supreme Court. Were all i think going to be grateful for years in terms of seeing the protections for our liberty. Cheryl right, right. Byron york, i want to thank you. James freeman of course is staying with us. Cheryl im seeing the Small Businesses where i live, which is new york city, struggle and so many have closed in the midst of all of this and its heartbreaking. These are good, hard working americans that just want to live their lives and james, we had a Small Business owner in the last part of the show, a veteran. I was looking at the numbers here. 1. 5 million jobs annually, 64 of new jobs are Small Businesses. I mean, if we were to help out the u. S. Economy, americans have a chance to do it tomorrow. James especially on the retail side. Weve been talking this morning about how the consumer is ready to spend this Holiday Season but a lot of it online. So if thats a natural shift, its one thing. But a lot of the shift this year obviously is coming from mandates that limit the activity and brick and mortar and push people online. Our governors want to be able to spend the cares act money they want with more flexibility and it stops at 12 31. So we need that changed before the end of the year. And finally, we need to help our families that are on unemployment have certainity about the level of Unemployment Compensation that theyre eligible for. So those three things i believe need to be done during this lame duck session of congress, before Congress Adjourns and long before the inauguration. I think we need to put together a common sense package and get it passed before the end of the year. Shes been the president of the San Francisco Federal Reserve bank. She comes to this position with a lot of experience and qualifications. But shes going to confront a fiscal challenge as we come out of this pandemic. How do we pay back the debt that weve incurred in fighting covid19 . And how do we get the economy growing again . And shell have to andahalf nt as treasury secretary to make sure we dont have large tax increases or large regulatory impediments to that economic recovery. Cheryl yeah. Well, as former chair of the Federal Reserve, she knows the often attempts by congress and by the public to either politicize the fed, make the fed go way beyond its mandates of full employment and fighting inflation. Shes going to have that in spades, james. There are those on the left who want the fed to lend money directly to state and local governments, something that i oppose. They have an idea that the fed could become the Climate Police person of the world by regulating climate through how it regulates the Financial Institutions of this country. So shes going to have a full plate, both on the fiscal side of her work as well as the regulatory side and part of that is to as treasury secretary resist the pligh plight sigh po. Obviously were looking to these two big senate races in january but the gop gained several seats in the house this past election. Do you think republicans are going to continue to have momentum and maybe flip the house in 2022 . Well, cheryl, on my view it was a good night in the house. We picked up seats. Nancy pelosis leftleaning Progressive Agenda did not meet well with voters and in fact, all those votes she took those centrist democrats and made them take cost them their seats. So i hope that with her more narrow majority and us winning the senate, maintaining control of the senate, that well be in a position in the house and senate to work with an Incoming Administration on a much more progrowth economic agenda, leadership agenda around the world and not succumb to the siren song of aoc and the left. But now with the stimulus delay and the logjam in washington on stimulus, a lot of those tenants are having a hard time, especially department stores. Covid has really accelerated what was happening because of ecommerce and whats happening on the other side of it is a huge opportunity to come buy these Shopping Centers, reuse them, retenant them or just move them into a whole different category of commercial real estate. Weve seen different uses like healthcare, like Education Centers that have popped up and of course you a lot of corporate campuses dominated by tech firms are coming in and buying Older Properties that theyre basically repositioning as corporate campuses.
